Public Prosecutor: Danny Boyle

In a nutshell, the prosecution is experiencing delays and the Committal Hearing date has been set for 24/9/12. GBC to remain in custody and to appear on that date. Mahony consented to this as he stated this was better than the original suggestion of November 2012.

Progress & Delays:
Prosecution was presented with a bulk brief last Friday from QPS
5 signed statements are outstanding including 2 from investigating officers, Roddick and Pascoe.
The delays were caused due to additional data being received.
The 5 statements are expected by the end of the week.
Financial forensics are expected by 14/9/12 from the accountant rather than by November as previously stated.

Thank you Woodstock. That's the one I was thinking of. Dr. Lynne Milne is a Forensic Palynologist, which, broadly speaking is the study of pollens. Dr. Milne may not be involved in this case at all, but her work and assistance to police in the past is fascinating. The quote from the link below is also very interesting in regard to taking tape lifts from the air cleaner and wheel arches of the car involved.

Allison was obviously transported to Kholo Creek in a vehicle and in all likelihood that vehicle would have picked up soil, pollens and vegetation from the area. These may have also been transferred back to the house on GBC's shoes or clothing, all unbeknownst to him. If these were found in the Captiva or the house, it would be a very strong argument for GBC having been at Kholo Creek.

Interesting stuff isn't it. It could very well be soil that was sent for testing or perhaps grass pollen from grass which only grows near the creek.

Great job checkout!
Even though I am disappointed in not finding out anything new today and having to wait even longer, as previously mentioned we can take comfort in knowing that hopefully nothing is being overlooked and gbc has to remain locked up while all this is happening. It would be worse if he was walking around free until proven guilty.
I do hope he is gaining a conscious for the way he has behaved. I also hope TM is squirming too. Unfortunately her children and family will also pay a price for her skanky behaviour.

Technology sure has changed our world and gbc may be wishing he had committed this crime in another lifetime, back when there was no such technology.

So it looks like the Committal Hearing (and not another mention) is scheduled for 24 September and GBC is to appear on that date. :woohoo:

Committal Hearing.

The magistrate’s role is to decide if there is sufficient evidence on which a jury could convict to send the defendant to trial in the District Court or Supreme Court.

• the prosecutor will present the case against the defendant and call witnesses to obtain their evidence.

• the defence lawyer or defendant may cross-examine these witnesses.

• the magistrate may invite submissions.

• after hearing all the evidence the magistrate will decide if there is sufficient evidence to put the defendant on trial.

• if satisfied the magistrate will charge the defendant.

• the magistrate will warn the defendant and then ask the defendant if they want to say anything in answer to the charge or enter a plea.

• if they plead not guilty, the defendant is commited for trial in the District Court or Supreme Court.

• if they plead guilty, the defendant is committed for sentencing.

• if there is not enough evidence the magistrate will dismiss the case.

Thanks Marly and you're probably right. I was going on Chekoutchik's quote below where she says Committal Hearing date and that GBC is to appear on that date. If it was just another mention, he wouldn't be required to appear.

Yep Mahoney's comment I think was in reference to the original November date when the accountants records were to be handed over by. The evidence still outstanding won't be in for another couple of weeks then will be passed to lawyers. They may take months to go through it all.

Definitely. What with Bruce Overland emails, incriminating Google searches, the timeline from his iPhone charger, the FaceTime call and now the forensic palynologist on the case, science has certainly turned around and bitten him. I bet he wishes he had been born back in his great grandfather’s day when rubbing sticks together to make fire was considered cutting edge technology.

There also has been a delay in the results of an examination of 32 computer and phone exhibits, believed to be seized from Baden-Clay's home and office.

It's starting to sound like the prosecution case is going to be highly circumstantial, from the sound of it, doesn't it? Even things on computers don't prove WHO did them, and have been known to have been falsified or planted in other cases. Easy enough to do - although we don't know just WHAT they have.

The more I think about this case, the more I find myself in one of two mindsets. Either GBC is innocent of the murder (although possibly guilty of other things, including the affairs etc), OR if he IS guilty of the murder, then he has been extraordinarily stupid.

And that is in both the carrying out of the crime, and also the attempted cover up. And I'm still not convinced that it would have all been about the money.

The police must have stuff that we have absolutely no inkling of yet, and I suspect that we will all be in for a fair number of surprises - from BOTH sides of the case.

Doc, the circumstantial evidence is substantial - not just a few bits and pieces. What are your theories if GBC is innocent? Who is the murderer? And let's face it, GBC is thick as two short planks - he's proved that to the public in the past few months.
