Dr Watson, my understanding of legal aid is that a client can choose a lawyer who then puts an application in to receive legal aid funding on behalf of the client. It would be the lawyers choice whether they were happy to accept a job based on this funding or not. Some lawyers may never do legal aid work, others only some, and then their are the agency's that seem to be purely legal aid. This is based on the experiences of people I know who have used legal aid in my non Qld part of Australia. Alioop, is my understanding correct? I think that sometimes which barrister you get is also dependent on their availability. If they are already committed to cases on certain dates then you need someone else. With legal aid, I think the funding is finite rather than unlimited........ And it seems to cover only what you basically need for a trial whereas if you pay yourself you can perhaps expect more. Like in many professions you will have very dedicated people who will put in many more hours of unpaid work for causes they believe in.
