I am very much looking forward to reading the motions by
Andrea Lyon. They will be a breath of fresh air compared to the ones
we have been forced to slosh our way thru with baez.

It will be very interesting to compare Lyon's death penalty motion to the one written by Terence Lenmon, where he alluded to an accident and a diminished mental capacity, iirc.

I think Lenamon's direction for the defense is about all they have to work with, IMO. I mean, what else can they really argue that might be believable by at least 1 juror?

Some of the psychologists who have been asked about KC have termed her "contact dependent". This conforms like a glove to Leonard's view of her. The psychologists explained that she was only cognizant of what or who was right in front of her at any given moment~no back, no forth, no peripheral. Even when she is chewing splinters in the jail visit with her parents, fist pumping, that is how she strikes me.

Hiya Ken! I think by the time this gets to trial, the Zanny the nanny defense will be long forgotten and Lyon will have replaced that with an accident/ emotional shock/"ugly coping"/fear of cindy defense. Total nonsense, but at least the defense may have a psychiatric expert testify that such a thing is possible.

Better then the nanny defense, but not by much, imo.

AL is a part of this case solely to get the Death Penalty dropped.

The provided link is re: OCTOBER 2002 SESSION
PRISONER REVIEW BOARD

"quote" "bolded by me"

The last witness offered to bolster Morrissey’s testimony was Andrea Lyon. Ms. Lyon, a former assistant public defender, testified that Morrissey told her that he had an unsolicited offer of a life sentence from Judge Samuels. However, Ms. Lyon also admitted that she strongly opposed the death penalty and that, if she could not win a case, her primary goal was to save her client’s life. Thus, Ms. Lyon, like McNamara and Morrissey, was an anti-death penalty ideologue and the post conviction court was justified in finding her testimony incredible.

P.S.
I have a question and it has probably been answered already but I can't member:

When this crap goes to trial---will AL be the Lawyer ask to questions to the witnesses or will it be JB (if he is still around)?

I haven't seen the Andrea L story, re: innocent man who spent 26 years in prison, in any of the Orlando news sites. Maybe I missed it, but does anyone know if this has been reported on ?

I know that the story was sent to almost every newspaper and TV news channel in S FL but for some reason nobody wants to touch it.

Well, the SA-LDB got back at her too in her email. :) She addressed the email to ALyons, not LKB and writes in the last para, "As I have indicated to Jose throughout the course of this case, it is not my practice to play "hide the ball" and will do what I can, within reason, to get you whatever information you need to adequately represent your client. I ask for the same courtesy in return. I do not see the need to waste court time on discovery matters as we have done in the past. I also understand my obligations under Brady, but thanks for the tips."

They are reaching. Judge Strickland won't be too pleased with yet another at the last moment motion hitting him less than 24 hours before the hearing.

Dang, I have to be gone tomorrow morning until late afternoon. I do hope there is some raw footage of this hearing.

I noticed they also want fingerprint info.

The prosecution's actions need to be beyond reproach. Either this is game playing or SA Ashton is inexperienced/disorganized. Neither possiblity is good. What an embarassment.

What is wrong with the defense, always being a day late and a dollar short with their motions? What a bunch of whiners! It seems like every time a hearing is very close, the defense files another motion, just making it in the day before. Hmmm....guess Ms. Lyons musta been too busy with her "teaching schedule" to get the motion in with time to spare.

Yanno, this trial won't happen for probably at least a year, with all the motions the defense keeps filing...why doesn't Ms. Lyons use the time right now to review all the "already released" discovery...then she can read all the non-released (as of now) discovery "as soon as SA-LDB can get it to her".

I want to preface my comments to show I am not looking to bash AL. I am very curious about her reputation and if she has ever been linked to any legal improprieties. All I have seen about her has been positive .
She has now linked herself with JB,who has several complaints with the FL Bar currently in play.
If Tony Padilla can prove JB gave false information to the court, that is a huge deal.I believe AL also signed the motion to the court. Why would she risk her reputation [or her liscense to practice] by working with JB?

Bold mine.

MissJames, I don't know if this is on this thread or not, but there was that case that AL wrote the papers on, for another attorney, about the man who spent years in prison for a crime that that attorney and another attorney knew was committed by another perp. These papers were put away, only to be brought out if the real perp died, IIRC. This doesn't make me think too highly of Ms. AL! She wouldn't say a word, (protecting herself and the other attorneys), and just let that man stay in prison, wrongly accused, and yet she will battle and cry big crocodile tears in the courtroom, for those clients (who are more than likely guilty) that she is trying to save from the death penalty. Kinda like a double standard to me!
