Well one thing is for sure, Casey will NEVER be able to claim ineffective counsel now !
 
Yes, this brings a bit of sophistication to the defense team, but so what? Her expertise will be used only in avoiding the death penalty, not in determining Casey's eventual guilt or innocence.
Well, I don't envision Casey flirting with her...
 
I look for the defense to add at least one more attorney to the mix before this is over. I fully expect that, before the trial begins, they will employ an appellate consultant. Do you know who the appellate consultant was for the OJ trial? Alan Dershowitz ... the same Alan Dershowitz that is reportedly writing the forward to A. Lyon's book.
The only ingredients missing, if they get Alan on, will be Barry Sheck and F. Lee Bailey. Did F. Lee retire or die yet, I haven't heard from him in a while...I wonder if Casey has written to the Innocence Project yet, it's never too early for her to start passing her name around.

F. Lee is still very much alive, he may even be here at WS!

Thank GOD the IP has very strict guidelines for the cases they take. Every case they take on is very expensive to the point of being prohibitive, even to the IP. They can't and won't help her. She doesn't meet the most important rule of the SODDI defense. There is no DNA here. No DNA, no IP!

Marti M. JB's PR woman is on also and said Lyon will be at the Defense table for the entire tiral.

And that truly totally adorable baby looks more like learned counsel than anybody we've seen so far! OT or not, I can't see that cute picture enough.
 
When interviewed,after today's hearing,Attorney Lyons stated she will not answer questions because she doesn't know the case. Yet, she proclaimed KC's innocence. She also stated SA doesn't have the evidence required to seek the death penalty. I've just briefly seen her while watching part of JVM's show tonight but I am not impressed. I envision the jury taking a nap if she questions witnesses or gives an opening/closing argument. And how could she not know at least the basics of the case ~ one of us might be better qualified! MOO

So are JB and LKB still going to present the case to the jury by cross-examining the state's witnesses and questioning the defense witnesses? I'm confused.

F. Lee Bailey was disbarred in Florida in 2001. To my knowledge, he has not filed for reinstatement.

Legal experts say a capital trial's defense should include, at a minimum, two experienced criminal defense attorneys, an investigator and a specialist at developing evidence for sentencing. The attorneys, experts say, should devote hundreds of hours to preparing and trying the case.

"Who your lawyer is is the single most important fact concerning whether you get the death penalty or not. The single most important fact--which is pretty scary," said Andrea Lyon, a University of Michigan law professor who previously tried more than 100 murder cases in Cook County without having a client sentenced to death. Lyon is known for her painstaking preparation, including research on the defendant and his background so that she can place the crime and the criminal into context. Was the defendant a victim of horrendous abuse? Is he mentally ill or retarded?

Lyon said Illinois should create an agency to train and certify defense lawyers in death-penalty litigation and help direct them to good investigators, forensic experts and other specialists.

"Is it cheap? Hell, no, it's not cheap. But it's a lot less expensive than these 12 deadly mistakes," Lyon said, referring to Illinois' exonerated Death Row inmates.


So where does Baez fall in this plan of hers??

FACDL Death Penalty Seminar, Day 2:


Day 2 of the Death Penalty Seminar was a long day, but well worth the time. One of the highlights of the day was a speaker on False Confessions, Detective James Trainum.

Det. Trainum is the project director for VICAP’s Violent Crime Case Review Project. In his session, Detective Trainum shared his own compelling and moving personal experience with a false confession. In his step by step deconstruction, Det. Trainum took us through the entire investigation to the discovery and gave insight on how to spot and fight a false confession.

The day ended with an inspirational session by the pioneering capital defense attorney and professor of law at DePaul University, Andrea Lyon. Prof. Lyon was the first woman to sit first chair in a death penalty case in the United States. After sharing some of her techniques, she brought most of the audience to the verge of (if not to actual) tears with her demonstration of a closing argument.

If you have the time, go read the last link I just posted about how to represent these clients. She states that during the penalty phase, defending mitigating factors requires the defense attorney to bring up painful and emabarrassing information about the client and their family (similar wording...paraphrasing here!)

"A capital defender thus faces the daunting tasks of
investigating and preparing to meet the evidence against the
client in the trial, as well as investigating and preparing to
meet the aggravating evidence at a penalty phase, in addition
to locating and presenting mitigating evidence—much of
which is a matter of shame to the client and his family."

wow, great find! I scanned quickly and printed it out for reading later tonight. My family is waiting on me for an already late dinner. ;)
