Anthonys May Sue Over Merchandise being Sold

Casey Anthony's parents, George and Cindy Anthony, have trademarked the name Caylee Anthony, in order to stop companies from selling merchandise.

The Anthonys' attorney, Mark Lippman, said they also trademarked the phrase "justice for Caylee" after everything from hats to underwear were being sold with the phrase.

A cease and desist letter was also sent to two websites selling the merchandise.

Fascinating! So, anyone can file for and receive a Trademark overnight? I would think that sort of thing might take months, or have they had this phrase "Justice for Caylee" for quite awhile now? Of course they have no plans on cashing in on this........not the admirable and stellar Anthonys!:sick:

I have to say that this is a First. I have never heard of a family trademarking a murdered family member's name before in my life.
It only proves what <unusual> people they really are.

I imagine they filed for it and if no one objects they will get it approved. Since someone is already using it I believe the company can object because they can show they have been using it for awhile..unless that rule has changed. My guess is because the shirts were printed and selling on the open market prior to the A's application the company may have an issue with the C/D letter because of loss revenue. Or the company will just donate them and use another phrase the A's will not like either and just not mention a name. There is a lot more than just sending it in and it's granted overnight. You have to use it.

As far as suing. What jury would not think "justice" for any victum is not appropriate? What excuse would the A's use to claim Caylee was being exploited when they themselves sold pictures of their grandchild for money?

I wonder if A's tried the "nice" way first and asked the company to please not use the name out of respect of their granddaughter. jmo

Trademarks are usually for commercial products and protection of labels, names, etc. in the open market. "You must be lawfully using the mark in commerce on or in connection with the identified goods and/or services...." I don't think you can just trademark something with the intention of not using it because then you would lose it.

So are the A's planning on using it commercially?

Do you have a link showing that they did in fact get it trademarked? I see the news thread but I'd like to see the proof other then what their attorney says.

That and I wouldn't think they could trademark the name with out ICA's consent since she is Caylee's next of kin and has rights to Caylee's publicity as AZlawyer and Katprint pointed out.

Am I missing something...why would anyone object to a t-shirt that says "Justice for Caylee"? Let people shout it from the tops of mountains. I would hope whoever manufactures the t-shirts believes in the cause.

You think it is okay for someone to be standing out in front of the courthouse hawking Justice For Caylee from a cart in front of the courthouse like this is some kind of carnival affair? That does not sound respectful to Caylee to me. If they were worried about anything like this before the trial I think it would have been done long ago.

AZlawyer made a comment about the law she thinks the lawyer is using to combat this. There is no mention of them using it commercially.

If I had to guess, I would say this is just more smoke and mirrors from the elusive Anthonys. I wish I could believe them but they have proven themselves to be untrustworthy and shady. moo

Not quite, so long as you are actually using (or intend to use) your name as a trademark, that is in association with the sale of goods or services. You can't simply register your name to block others from using it. You must actually be using the name as a trademark. Registration by the PTO can still be refused under certain circumstances, such as if your name is very common.

Let them sue. Let them use the money they don't have. Let them do whatever their little tiny hearts desire. They will see their day. Silly parents. Their "decisions" about what is right or wrong have brought them right to the place they belong! (Rhyme was not intended but it fits.)

Sue away silly parents. You have money to sue for trademark but not to defend the daughter you so adamently believe is innocent? Guffaw to you both.

The GRANDPARENTS of a deceased baby girl have filed for trademark on her name, specifically "Justice" for her name. How low can things get? They stand tall and proud behind the only known suspect in their Grand-daughter's death and have the time and inclination to file this petty suit? $$$$ Is what these Grandparents seek while they hang their hat on the only possible suspect ever mentioned!

I have no problem with the A's wanting to stop all the merchandise associated with Caylee's name being hawked all over the place and people who really have no association with the case profiting from her death.

What I have a problem with is they want a full accounting of everything so they can collect another windfall, thus profiting again from the loss of Caylee. Cease and desist letters should be enough.

I apologize if this has been brought up, but watching a special recently, the IS host Vinnie Politan took a tour of the remains site and on a tree were lanyards with Justice for Caylee printed on them. I just wonder of this is where the Anthonys saw and got this idea.

I thought they were gonna get Caylee's name all locked up a couple years ago. What happened to that ?
