Really scary. I wouldn't be afraid of that little kid, at least not in the day light if he approached me without any weapon. He just looks so young/small for his age. I wonder if the 16 year old was used to distract her so the bigger 18 year old could attack from behind or get in her car when she wasn't looking?

Security footage at the Conway Commons shopping center showed Fragstein leaving T.J. Maxx around 3:30 p.m. that day. Her Honda was then seen traveling through the parking lot and along Elsinger Boulevard “at a high rate of speed,” authorities said.

Police have arrested two teenagers — 18-year-old Tacori Mackrel and 16-year-old Robert Lee Smith Jr. — on kidnapping and theft of property counts in Fragstein’s abduction. They are expected to be charged as adults.

Smith was transported from Jefferson County to Faulkner County on Monday, and Mackrel was awaiting transport to Faulkner County as of Tuesday morning.

On Friday, Mackrell appeared in court -- he and his attorney, Bill James, filed several motions. One of the motions requests no death penalty, and another requests a change of venue for Mackrell's trial.

This is the reason the death penalty should be available in every state. There are times when it is the only thing criminals fear...their own mortality. They have no compassion or empathy on any level. Life in prison for them is a reward. No work and everything free. MOO

Robert Smith III is scheduled to appear next at 2:30 p.m. Oct. 19 in Faulkner County Circuit Court for a pretrial hearing prior to standing trial Nov. 2-6.

His 20-year-old cousin, Tacori D. Mackrell, is set to stand trial Sept. 21-Oct. 16. Mackrell faces the death penalty for his alleged involvement in Fragstein’s 2018 disappearance and death. Because he was 16 years old at the time of the alleged offense, Smith cannot face the death penalty.

With the capital murder trial against Tacori Mackrell starting later this month, the defense team is asking a circuit judge to consider having a four-day per week trial schedule.

The 20-year-old Pine Bluff resident is charged alongside his younger cousin, 18-year-old Robert L. Smith III, with capital murder, kidnapping, robbery and theft of property. Mackrell was 18 years old when he and his then-16-year-old cousin reportedly kidnapped 71-year-old Elvia Fragstein from the Conway Commons shopping center parking lot on July 7, 2018.

Prosecutors are seeking the death penalty against Mackrell. Because of Smith’s age at the time of the alleged offense, he cannot face the death penalty per Arkansas law.

The murder suspect is scheduled to appear Friday in Faulkner County Circuit Court for a pretrial hearing leading up to his death trial, which begins Sept. 21 and is expected to run through Oct. 16.

The pretrial hearing in Mackrell’s case will begin at 9 a.m. Friday.

A jury of 12 plus five alternates was finalized Tuesday in the capital-murder case of a Pine Bluff man accused of kidnapping and killing a Wooster woman in a crime that began while she shopped in Conway.

The trial is set to begin at 9 a.m. Thursday with Faulkner County Circuit Judge Troy Braswell Jr. presiding and is to continue through Oct. 16.

Jurors hear interview audio during day three of Fragstein murder trial | thv11.com

On Monday, prosecutors called two witnesses to the stand, both of them investigators in the case. Several hours of interview audio was also played for the jury.

The trial is set to resume Tuesday at 9 a.m.

Prosecutors are expected to rest their case on Tuesday.

As defense attorney Jeff Rosenzweig discussed the witnesses he plans to call, he noted that Tacori Mackrell has the right to testify, suggesting that he could possibly take the stand.
