Wow, I didn't expect that the prosecution would seek the death penalty against Cathy Torres. Both of them definitely deserve it though, for what they did to little Isaiah :mad:

This is for sure a DP case. My money is on Mom wanting to plead guilty to something less and testify against the other monster in the home. I am feeling too distraught and childish to give him a name.

I am not a fan of DP for the most part. It doesnt make sense to me and the 10 years of automatic appeals in place as a safe guard has to be grueling for the families that just need to get on with their lives, or whatever is left of their lives.

But then a case like this comes along and I have to wrestle with myself over it. I think about those little girls and how they will ever survive this.

Just read this case (from the beginning) today. Read all the reports, msm articles, FB pages and little Isaiah's older brother's posts. Absolutely heartbreaking :(

When I read such things about adult monsters preying on defenseless little people, it honestly makes me wish some form of archaic justice would be served. Something like a public hanging, or burning at the stake. I know that sounds creepy but it sort of feels justified. Any adult that lays a finger of harm on a precious child should face the worst possible consequence.

As for the maternal unit (she was never a mother), I actually believe paternal unit (same applies) actually did do all those things she stated in her order of protection against him. I just don't care. If he was doing that to her and the kids (and I'm sure he was, the filthy pig), it was HER job to get them all to safety, no matter what. She instead chose to be spineless and allow him to do whatever he wanted, and that beautiful boy suffered and died as a result of HER choices, as much as her husband's.

My heart goes out to all of the kids, step-kids, half-siblings, and extended family.

They were not charged with rape because that happened in Missouri. I haven't heard anything about whether or not they will be charged with rape in Missouri. The article does say that rape is tied to the murder charges..
However, the child died in Benton County, so the capital murder charge was filed in that jurisdiction, Smith said. In addition, the rape is tied into the Benton County capital murder charge since the rape was part of the theory about how the child died, the prosecutor said.

Delay murder trial, lawyers ask
Attorneys for a man accused of killing his 6-year-old son want to delay their client's May jury trial because they need to interview people in California and El Salvador, according to a court motion.

Mauricio Alejandro Torres, 45, and Cathy Torres, 43, of Bella Vista are charged with capital murder and first-degree battery in the boy's death. They have pleaded innocent and are being held without bail in the Benton County jail.

Prosecutors want to try Mauricio Torres first. His trial was set to begin May 6 but was pushed back Friday. Jeff Rosenweig, one of Mauricio Torres' attorneys, requested the delay. Maurice Isaiah Torres, 6, was pronounced dead at an area hospital March 29. A medical examiner later determined the boy suffered from chronic child abuse, and his death was from internal injuries caused by rape.

Cathy Torres' trial was set for Aug. 22, and Rosenweig requested that date for her husband's trial.

Circuit Judge Brad Karren scheduled a motions hearing for 2:30 p.m. June 13 during a Wednesday conference call with prosecutors and Mauricio Torres's defense team. Torres' attorneys told Karren they soon will file motions, but they didn't discuss specifics.

Jury selection was to begin today, but the defense requested additional time to prepare, and Karren reset the trial to start Aug. 22.

I'm glad to see DP requested in these horrific cases against children. At least when it is on the table defendants will have incentive to plead guilty and accept LWOP removing them forever from society and sparing the expenses, both emotional and financial, of a trial.

The jury trial for an accused child killer has been delayed until November because of his defense attorney's medical condition.

Mauricio Torres and his wife, Cathy, are charged with capital murder and battery in the first degree in connection with the death of his 6-year-old son. Prosecutors are seeking the death penalty.

His jury trial was scheduled to begin Aug. 22. It is now set to begin Nov. 1, according to Tuesday’s ruling by Circuit Judge Brad Karren.

Thank you, once again KayElJay, for keeping us updated on the latest (delays) I the adjudication process. I hope that the trial will begin on 1 November, but I'm honestly not holding my breath. This seems to be the new SOP for defense teams in heinous capital murder cases: delay at all costs :cow:
