Capital murder involves murder plus some type of aggravating circumstance, such as murdering a police officer or firefighter while they are on duty, murdering a person while committing another felony like rape or abduction, or murdering a child.

From wikipedia:
The following are capital crimes in Arkansas:

  • Treason; and
  • Murder involving one of the following aggravating factors:[4]
  1. The murder was committed by an offender imprisoned as a result of a felony conviction.
  2. The murder was committed by an offender escaped after being sentenced to imprisonment as a result of a felony conviction.
  3. The offender previously committed another felony, an element of which was the use or threat of violence to another person or the creation of a substantial risk of death or serious physical injury to another person.
  4. The offender in the commission of the capital murder knowingly created a great risk of death to a person other than the victim or caused the death of more than one person in the same criminal episode.
  5. The murder was committed for the purpose of avoiding or preventing an arrest or effecting an escape from custody.
  6. The murder was committed for pecuniary gain.
  7. The murder was committed for the purpose of disrupting or hindering the lawful exercise of any government or political function.
  8. The murder was committed in an especially cruel or depraved manner, that is, preceded by mental anguish, serious physical abuse, or torture upon the victim prior to the murder.
  9. The murder was committed by means of a destructive device, bomb, explosive, or similar device that the person planted, hid, or concealed in any place, area, dwelling, building, or structure, or mailed or delivered, or caused to be planted, hidden, concealed, mailed, or delivered, and the person knew that his or her act would create a great risk of death to human life.
  10. The murder was committed against a person whom the defendant knew or reasonably should have known was especially vulnerable to the attack because:
    • Of either a temporary or permanent severe physical or mental disability which would interfere with the victim's ability to flee or to defend himself or herself; or
    • The victim was 12 years of age or younger.

JACKSON COUNTY, Ark. (KAIT) - Quake Lewellyn has been arrested and charged in the murder of Sydney Sutherland, according to sources close to Region 8 News.

Authorities discovered Sutherland’s body Friday afternoon, ending a nearly three-day long search for the missing woman.

Authorities also said Saturday that the Arkansas State Medical Examiner in Little Rock confirmed that the body found Friday in Jackson County was that of Sutherland, according to Jackson County Sheriff David Lucas.

Lucas said around lunchtime Saturday that the state medical examiner’s office was able to confirm the identity through DNA.

Lucas said Friday that a Jonesboro man was being held in jail on a homicide charge in connection with the Sydney Sutherland case.

During an evening press conference, Lucas spoke about the case.

Lucas said a body of a female, that was believed to be Sutherland, was found around 2 p.m. Friday. The body was sent to the Arkansas State Crime Lab for identification.

Lucas did not formally release the name of the suspect Friday and Saturday, pending charges in the case.

The sheriff said the case is ongoing.

However, while not disclosing the name of the suspect, Lucas said the suspect did know Sutherland.

Earlier in the day Friday, Jackson County law enforcement had confirmed they’ve found a body in the area where they’ve been searching for the missing Jackson County woman.

Sheriff Lucas told Region 8 News that the body was found around 2 p.m. Friday.

Friday was the third day in a row investigators and volunteers spent searching for Sutherland.

She was seen jogging off Highway 18 between Newport and Grubbs around 3 p.m., going west.

Hundreds in Jackson County gather for candlelight vigil to remember Sydney Sutherland. | KARK

The vigil was held by the Class of 2014 from Tuckerman High School where Sutherland graduated.

“It’s all about Sydney and remembering her,” said GM, class president.

Hundreds attended the vigil and lit candles in remembrance of Sutherland.

“She was family,” said T.P, who worked with Sutherland. “Her mama was her best friend, her nieces were her world and don’t forget her dogs. Sydney loved her dogs.”

Others talked with us about the legacy Sutherland left behind in Jackson County.

“She didn’t have to have recognition, she didn’t have to be in the front. She didn’t have to be recognized for anything, she was just a silent servant.

The vigil lasted about an hour. One woman we talked to said though Sutherland was only 25, she had more of an impact in a few short years than most do in a lifetime.

“She was a firecracker, she was sassy, she was loving, she was caring, and she was compassionate,” said Sutherland’s friend.

While friends say the future is uncertain, they say Sutherland will never be forgotten.
