[2-950] Introduction

The Crown can rely upon the accused’s post-offence conduct as evidence of a consciousness of guilt. This will usually be in the form of a lie (either in or out of court) or flight (absconding to avoid arrest or trial). But it can include other forms of conduct: McKey v R (2012) 219 A Crim R 227; see Pollard v R (2011) 31 VR 416, where the evidence of the accused hiding his mobile phone was admitted on this basis. Such evidence will generally be part of a Crown’s circumstantial case or evidence supporting direct evidence such as an admission.

There was the cash reward that police say he could never pay. The "argument" and the deleted Facebook account. The photograph that was allegedly edited for the missing person's poster before she was even reported missing.

The public displays of grief and torment, the extensive appeals for information and the social media campaign juxtaposed with claims he had moved on to other women almost immediately.

Detectives allege Mr Newson became "jealous and angry" at Ms McBride and late on September 29, a number of searches were made from Mr Newson's laptop, looking for instructions on how to delete a Facebook account.

At 11.52pm, Ms McBride's Facebook account vanished.

At midday on September 30, the day she disappeared, and during the drive to Muswellbrook, Mr Newson allegedly took a number of photographs of Ms McBride, seated in the front passenger seat of his car. An examination of Mr Newson's phone later allegedly revealed that between 5.17pm and 5.23pm that day, before Ms McBride had been discovered "missing", one of those photographs was rotated into a portrait shape and edited to remove Mr Newson's arm.

BBM- doesn't this all point to premeditation???

The case against him is entirely circumstantial.

There was no blood found in his vehicle, no known witnesses to the crime, no CCTV, no DNA and police don't know where the alleged murder occurred.

Even though circumstantial, it's pretty convincing circumstantial evidence.

Strangling someone does not produce blood and is the choice for many intimate partner murders.
I don't think that there would have been blood in Karlie and Khandalyce's murders, either.

True Jennifer, but I'm afraid, I think she was violently bashed to death :mad:

A post-mortem examination identified significant blunt force trauma to her face and back of her head, which was consistent with at least two blows to the skull and two to her back.

Also her DNA would be all over Sayles car anyway ( we don't know how she was transported to Owen's gap thou) ...........the cops hopefully know.

Yeah, outside of the car, then. Probably drove her where she was found and bashed her there.

Sayle Newson - accused of murdering his girlfriend, mother-of-two Carly Dawn McBride, 31, and dumping her body at Owen's Gap in September, 2014 - likely to face a four-month trial in April next year. Mr Newson was arraigned in @NSWSupCt today and pleaded not guilty.

Boyfriend pleads not guilty

The pair are likely to face a four-month trial in Newcastle Supreme Court beginning on April 29, 2019.

But the matter was adjourned to October 5 in Sydney Supreme Court to confirm that date and finalise who will be the trial judge.

Newson, Cunneen to face May trial

Former Muay Thai kickboxer Sayle Kenneth Newson, 41, of Buff Point on the Central Coast, was represented by solicitor Mark Ramsland in Sydney Supreme Court on Friday. Mr Newson was arraigned in the same court in September and pleaded not guilty to murdering 31-year-old Ms McBride, his girlfriend of about eight weeks, in September, 2014.

Mr Newson’s co-accused, James Anthony Cunneen, represented by public defender Peter Krisenthal, was also arraigned in September and pleaded not guilty to accessory after the fact to murder. But the matter had stalled over the past few months, with the first trial date vacated due to insufficient court time.

On Friday, the parties agreed to reduce the length of the trial, which will begin on May 20, 2019.
