Wednesday 12th March 2014 Day 19 of Daniel Morcombe Trial today.

It is expected that Justice Atkinson will conclude summation & direction to the Jury today, then the Jury will retire to consider their verdict.

JURY TO CONSIDER MORCOMBE VERDICT
A jury may find Daniel Morcombe's accused killer Brett Peter Cowan guilty of murder even if it believes he had no intention to kill the 13-year-old schoolboy.

Justice Atkinson told the jury it did not need to be satisfied that Mr Cowan intended to kill Daniel to reach a guilty verdict...an intention to kill did not need to be long standing..."It is sufficient for it to be formed in a matter of seconds ... immediately before the relevant event," she said...

Justice Atkinson said "indecent dealing" was not limited to touching and included "acting towards the child"..."It would include starting to pull down his pants, his shorts," she said...

Justice Atkinson retired the Jury of six men and six women to consider its verdict at 12.13pm...

In her summing up, Justice Atkinson told the Jury the prosecution had to discharge its burden of proving the guilt of the defendant by proving it beyond reasonable doubt.
She emphasised the Jury must approach its' duty dispassionately, deciding the facts upon the whole of the evidence...
She summarised the evidence for the Jury and the closing statements from both the prosecution and defence.
She took the Jury through a 'question trail’ to help them decide a verdict in the case...

Justice Atkinson told the Jury yesterday: "The evidence is what you've heard in this court and not recollections of what you might have read in the newspaper or seen on television or heard on the radio at some time during the past or even during the trial"..."You should dismiss all feelings of sympathy or prejudice against the defendant or anyone else..."Nor should you allow public opinion to sway you, you must approach your duty dispassionately."

Justice Atkinson took Jurors through a transcript of a 2011 video-recorded conversation between Cowan and an undercover police officer in which Cowan confessed he “did it”.... She instructed Jurors to carefully consider this key piece of evidence prosecutors say proves Brett Peter Cowan killed the Queensland schoolboy...

Justice Atkinson told jurors they must be satisfied Cowan did “give the answers attributed to him” in the video’s transcript, and also that his confession was honest... “It’s up to you to decide whether you’re satisfied those things said by the defendant, which would tend to indicate that he is guilty of the offence, were true,” she said. “Because if you’re not satisfied, you couldn’t rely on them as a guide to prove his guilt.”

Jurors were encouraged to replay the confession video – of which they have a copy – as often as they like during deliberations...
