Letter naming Lin killers 'not given to cops'

http://www.sbs.com.au/news/article/2009/08/20/letter-naming-lin-killers-not-given-cops

Just reading up on this case now and am wondering whether Robert Xie wrote this letter. Does anyone know?

Seems like not much information is leaking out from the trial, I can't find anything more about this letter. Hopefully we will find out soon.

Brenda Lin has rejected speculation her uncle was involved in the murder of her family

http://www.news.com.au/national/bre...er-of-her-family/story-e6frfkvr-1225891549056

Does Brenda still believe that Robert Xie is innocent?

The latest article the daughter is now teenage girl, who cannot be identified for legal reasons.

It appears the family cannot believe he did this. Details are very scant. I wonder how much evidence LE have against Xie?

What evidence do they have? Here is only some of it:

The prosecutor has told the court Xie was motivated by bitterness towards some members of his family.

The Crown says that Xie confided in a prison inmate about the murders, including how he purchased a hammer to carry them out. Xie told a fellow prisoner he bought the hammer used in the attack from a $2 shop because the store had only dummy CCTV cameras.

Xie told an undercover police officer he planned to use DNA from a dead man to implicate someone else in the killings.

However, the defence lawyer said aspects of the Crown case against his client are "pure speculation" and "assumption".

This is because some Crown witnesses set to give evidence at the trial were not questioned by police for months, even years after the killings his client is accused of so memory will have a role to play in this and some witnesses did not have English as a first language.

Also he said that while his client did not murder the family, the morning after the killings, Xie went to Mr Lin's house to look for him when Mr Lin did not turn up for work and Xie only ever talked very generally about his case to the prisoner.

A man accused of murdering five members of a Sydney family as they slept in their beds seemed "nervous" and "scared" when he told the surviving relatives about finding the bodies the following morning, a Sydney court has heard.
But the accused killer also allegedly cried during the same fraught conversation.

This seems to be the most damning evidence, Robert Xie's wife Kathy Lin ringing 000. She obviously knew her brother and family would be murdered, how?
The trial of Robert Xie has heard that police who found five alleged murder victims in a Sydney home were responding to a triple-0 call in which a woman screamed, "Someone is going to die".
Constable Levins told the court the female informant phoned back a short time later and said she thought her brother was dead inside his house.

I have not really been able to work out what Kathy Lin's role was in this case and the timeline for her actions.

Have they proven that it was her who phoned 000 as this is not what was stated?

I thought that she had taken sleeping pills.

When she made that call screaming, "Someone is going to die". was it after he left to do it (or after they were already killed as a pretence or something)?

Or was she at their house and when?

Because she is his wife, will she be called to give evidence?

How long did she take to call back again?

How would she know that her "brother could be dead inside his house" if Xie did not tell her?

IMO this is very telling yet the family and the police for a year or so blamed strangers.

Also why is the media so quiet about this case this week?

It will be interesting to see if she is called. Unless the prosecution have irrefutable evidence that she has information to support their case, I can't imagine they'll call her because she may well be a hostile witness. Regarding the law on this aspect ...

"Most witnesses can be subpoenaed to court and compelled to give evidence, but there are some exceptions. The accused, her or his spouse, and a co-accused may give evidence, but cannot be compelled to do so. A spouse, however, can be compelled to give evidence in domestic violence and child sexual assault cases."

http://www.abc.net.au/news/2014-06-10/xie-jury-discharged2c-trial-aborted/5512654

A Supreme Court judge has aborted the trial of the man accused of killing five members of the Lin family in Sydney.

Discharging the jury, the judge said new evidence had emerged late last month which may make a substantial difference to the trial of Robert Xie.

Oh wow, what a turnaround. The article said all notes taken during trial will be destroyed. I can't imagine what has occurred, if it's in Xie's favour or not.
Just hope justice is served, this poor family. :please:

Whaaaaaaaaaaat????????????

Crazy! This trial has been ver disjointed!

You know I looked up some other cases where trials have been dropped in Australia and sometimes they never come up again, however they weren't murder trials, this time they're re-running the trial as early as July .. I wonder if there was an issue with some of the forensics, clearly it would have to do with something the jury already heard which was so damning that they couldn't unhear it.

I am very curious as to what that evidence could be and what new evidence the Defence has now as it seems to be in favour of the Defence.

Brenda? I'm wondering if it has something to do with her, she always defended her uncle and has been very quiet.

  • #95
Yes I agree about Brenda as she was pro-Xie but is she still now?

Could it be something about that inmate's evidence?

  • #96
Oh yes true .. wasn't there some kind of altercation at the prison .. arrggghhh!! The justice in this case has just been so delayed, but it's worth waiting I guess for a firm conviction.

The man accused of the 2009 Lin family murders is set to face trial in August.

The jury in Lian Bin "Robert" Xie's high-profile trial was discharged earlier this month after new evidence came to light.

The new trial, which will start on August 4, is expected to last longer than four months, Justice Peter Johnson said during a mention at the NSW Supreme Court on Monday.

A pre-trial hearing will be held in the same court on Thursday, with further pre-trial hearings scheduled for the week beginning July 21.

The trial is going to go past 4 months!! GBC trial is expected to wrap up in 2 weeks.

BBM, MOO, etc., but I don't believe making a frantic call like that to an emergency line necessarily implicates her as having prior knowledge, but I do see how someone could gather that based on the news reports linked. The way I understood those statements was that she had called while she was at the house, maybe assuming they were still alive, but barely - i.e., "please, if you don't send an ambulance quickly, someone is going to die!" The second call may have been placed because her brother wasn't at work that day and she couldn't otherwise get in touch with him. It may have taken her a while to put two and two together. I guess we'll all have to wait until July at the least to find out anything new.

Yes, I have been curious about Brenda. She was away when her family was murdered and immediately went to live with uncle after her family was killed.

Jurors warned of 'gruesome' Lin evidence

Potential jurors for the Lin family murder trial have been warned they will see "gruesome and graphic" evidence of the five killings and hear allegations of sexual abuse against a young woman.

Lian Bin "Robert" Xie, 50, is accused of murdering five members of the Lin family in their North Epping home in Sydney in July 2009.

His alleged victims are the father Min 'Norman' Lin, his wife Yun Li 'Lily' Lin and her sister Yun Bin 'Irene' Yin.

Norman and Lily's two young boys Henry Lin and Terry Lin were also killed.

Xie reiterated his pleas of not guilty to all five murders at the start of his Supreme Court trial on Monday.

.............................

Due to the unusually long duration of the trial - which is expected to run for four months - there are 15 jury members as opposed to the normal 12.
