I remember she lived with them right after the crime though, because I for one was appalled by it.

Just after 9:00 am on May 5, 2011, Brenda's uncle Lian Bin "Robert" Xie, 47, was arrested without incident at his home in North Epping, following an extensive investigation. Brenda had been living with Xie and his wife Kathy Lin since the murders. On 19 December 2012, Robert Xie was committed for trial.[SUP][1]

They probably convinced the court that custody would be better placed with them .. it looks (from your link) as though the grandmother may have attended court in an infirm condition.

A LOT of controversy in this older article about the decision to leave his niece in Xie's custody ....

Mr Xie's ''fondness'' for his niece and the fact that she had been overseas when her family was killed led police to believe she was safe in the home, he said.

In a letter to the editor, one Herald reader, Mukul Desai, wrote: ''It beggars belief why police would allow that young girl to stay with the alleged Lin family killer when they suspected all along that he was the prime suspect. Breathtaking!''

''We have a young girl whose family has basically been wiped out,'' said the vice-president of the Victims of Crime Assistance League, Howard Brown.
''They would have then placed listening devices in the house so that they were then able to monitor whether [the girl] or her aunt were at risk,'' he said. ''There is no way in the world that [police] would have put [her] at risk. I have no issues with the way they've dealt with it at all.''

Yeah .. ding,ding,ding .. red flag. What a stupid risk to take with someone they 'knew' murdered her whole family .. while she was safely out of the country.

Evidently they did not have their supposed 'listening devices' in her bedroom! Grrrr ....

The head of the homicide squad, Detective Superintendent Peter Cotter, had said the girl's safety was always put ahead of one of the largest homicide investigations in NSW history.

Yesterday victims of crime advocates were convinced police would not have endangered her.

Well, they were wrong.

So the police believe only her life was worth saving? OMG, the damage that has been done to her, to be used by the man that killed her whole family!! She will need therapy for a very long time, the psychological damage done is irreparable, imo. :cry:

Oh we will .. and they will .. and let's focus on the motives too. Plenty of all of that, as far as I can see. Prosecutor Tedeschi :heartluv: will make sure it is all brought to light.

The only dicey area that I can see in this trial is the electric box. Did I read somewhere that there was a bloody handprint on the electric box, and that it did not belong to Xie? Can't find the info or a link now.

If there was a bloody handprint ... whose was it ... and why was it bloody if the electricity was turned off prior to the murders?

Can't find anything about a handprint - they have shoe prints though mentioned a few times, and also in this old article from his bail hearing.

The court was told police found 24 shoe impressions on the first floor of the Lin home, which "the majority ... matched to the tread used on three models of ASICS brand men's running shoes" with a number of those "found to have been made by a men's US size between 8.5 and 10.5".

"At the time of the offences, the accused owned a number of pairs of ASICS brand runners in size men's 9.5 US," documents state.

"After a police interview with (Xie's wife) Kathy Lin about these shoe impressions, the accused is recorded on (surveillance) video retrieving objects that appear to be shoeboxes and is later recorded on video cutting up these ... with scissors and placing the pieces into a shredder and also into a bucket containing a liquid. The accused flushed the contents of the bucket down the toilet.

"The Crown case is that one of the objects disposed of by the accused was the shoebox that had previously contained the ... men's running shoes owned by him."

He had a weapon, his victims were asleep and also small, and two of them were just children .. I don't think the jury is going to be too swayed by this 'physical size' argument.
