The Dodd family might now be one step closer to finding answers about Hayley’s disappearance.

They will be facing accused Francis John Wark at a Perth court on September 28 for a committal hearing which will determine if there’s enough evidence against him to stand a trial.

A Perth court has been told expert evidence is causing delays in the case of the man accused of murdering teenager Hayley Dodd 17 years ago.

Francis John Wark was charged in December last year with killing the 17-year-old, who was last seen alive in July 1999 walking along a road near the town of Badgingarra.

The next court appearance for Wark is on November 30th.

'He appeared in the Stirling Gardens Magistrates Court this morning via video link from Acacia prison, and was committed to stand trial.

Wark was remanded in custody until his next court appearance in February.'

Francis John Wark to argue for judge-alone trial

The man accused of murdering missing teenager Hayley Dodd will face a two-day hearing next month to argue for a judge alone trial, with his lawyer citing concerns publicity surrounding the case could prejudice a jury.

When he appeared in the WA Supreme Court by video-link from Acacia prison on Thursday, Mr Wark's lawyer Darryl Ryan said his client's application for a judge-alone trial would be centred around press reports about Mr Wark and Hayley's suspected murder.

During the hearing, Justice Stephen Hall revealed the State would rely on a number of statements made by witnesses who have since died, which Mr Ryan said he did not oppose.

Justice Hall will consider Mr Wark's application for trial by judge alone on May 22 and 23.

WA’s Supreme Court said today that Mr Wark’s application that he should be tried without a jury because of the extensive publicity surrounding the case had been granted.

And Justice Janine Pritchard also ruled that so-called “propensity evidence”, which details former crimes which may have relevance to guilt in the current accusations, will also be permitted to be used by prosecutors.

Mr Wark has pleaded not guilty to murder and is due to go to trial in October.

Mr Wark’s lawyer Darryl Ryan has previously said that his client’s application for a trial without a jury was lodged because of “concerns” about publicity surrounding the case.

He was remanded in custody to appear in court again next week."

"Court documents reveal that prosecutors will be able to use evidence given by a woman known as Ms D, a hitchhiker who was raped and assaulted by Wark in Queensland.

The assault was described as ‘humiliating, denigrating and violent’.

Wark was sent to prison in relation to her assault in 2007.

The State’s case relies in part on an earring and a hair found in Wark’s ute following Ms Dodd’s disappearance on July 29, 1999.

In the document, Justice Janine Pritchard called the State’s case circumstantial, considering Ms Dodd disappeared and her body had never been found.

Justice Pritchard said Ms D’s evidence showed a propensity on the part of Wark to commit crimes of violence against women in circumstances where he had given a lift to that woman.

The State will be able to use Ms D’s evidence Justice Pritchard ruled.


Evidence the State intended to use, where Wark told an associate “well if it was me I’d throw her under here”, was rejected by Justice Pritchard.

It was also ruled the State will be able to use evidence submitted by five witnesses who have since died.

Wark was extradited from Queensland in 2015 and charged with the murder of Ms Dodd.

His Badgingarra home was searched after Ms Dodd went missing and again in 2013, though Wark no longer owned the home.

Ms Dodd’s mother Margaret started a petition to haveno body, no parole legislation introduced*to Parliament.

She received support from Sarah Spiers and Craig Puddy’s families, whose bodies have also never been found.

The State Government fulfilled an election promise by introducing the legislation to Parliament."

Her body and belongings have never been found, except for - the state alleges - a distinctive earring she was wearing at the time of her disappearance that was found in the vehicle of the man accused of murdering her, Francis Wark.

The 61-year-old on Monday stood trial in the Supreme Court of Western Australia by judge alone, 18 years after Hayley's disappearance.

In 2007, he raped a Queensland woman he picked up while she was hitchhiking.

Ms Burrows said the state will use the rape conviction as propensity evidence Mr Wark was capable of picking up a hitchhiker and sexually assaulting them.

The state will also rely on evidence Mr Wark asked the Queensland woman for her earring.

"He had a tendency to keep a trophy, a trophy of his violent conduct towards women," Ms Burrows said.

‘Witness Lisa Frederickson — who was staying at a caravan park in the Mid West town of Dongora with Ms Dodd — told the court the teenager had planned to go to Badgingarra for a few days to visit friends, but was intending to return to Dongara so they could continue their trip together.

The pair had hitchhiked from Mandurah to Dongara to work as rouseabouts for a shearing team.

Ms Frederickson — who now lives in Queensland — told the court she gave Ms Dodd her pocketknife and about $5 in change to phone the caravan park when she reached Badgingarra.’

‘Ms Frederickson also told the court the pair had gone shopping for jewellery in Dongara two days before Ms Dodd disappeared.

The mother-of-five said Ms Dodd bought a pair of silver cross earrings with a turquoise stone in the middle.’

‘The court yesterday heard how an earring was found in 2013 during a review of police exhibits when the bench seat cover of the utility Wark was driving at the time was examined.

Prosecutors allege Wark forcibly removed the earring due to a "tendency" to keep jewellery as a "trophy of his violent conduct against women".’

‘A convicted rapist accused of murdering West Australian teenager Hayley Dodd has argued an earring that was discovered in his car, and matched the style she was wearing when she went missing, are commonly found.’

‘Helen Louise James, who ran the Tree Frog new age products store in Dongara where Hayley bought ankh-shaped earrings two days before her disappearance, told the WA Supreme Court on Wednesday they were mass-produced, very popular and would have been sold at similar shops.

The earrings, depicting an ancient Egyptian symbol representing life, are one of two key pieces of physical evidence against Wark in a case defence counsel Darryl Ryan describes as entirely circumstantial.’

‘Ms James was shown a photograph of that earring and said the pair Hayley bought were "very similar".

She previously told police they were "identical".’

Mr Ryan argues the state cannot prove the earring belonged to Hayley.
