'TO SAY that watching last night's A Current Affair episode on the tragic death of Lynette Daley was difficult for her mother and step-father would be an understatement.

But after five years waiting for justice, keeping her story in the public eye is more important to Gordon and Thelma Davis.

Even if it means seeing one of the men accused of involvement in her death, Adrian Attwater, on the television screen after being tracked to Townsville by the ACA crew.'

"He's just a 🤬🤬🤬🤬🤬🤬🤬 - he doesn't care. He shows no remorse and no guilt," Mr Davis said.

"He's gotten away with it, at least he thinks he has."

Mr Davis says he is confident, however, that karma will catch up with Attwater, and he hopes it will be in a way that coincides with justice for his step-daughter.'

'Last Thursday, Gordon and Thelma met with NSW Attorney General Gabrielle Upton and DPP's Lloyd Babb over Skype, to discuss the independent review into the DPP's decision not to prosecute Attwater and his friend Paul Maris over the controversial events which led to Ms Daley's death in 2011, despite being charged.

While Mr Babb asked them what he could do for the couple, neither he or Ms Upton could give a timeframe of when they would see the review's outcome.

"All they said was it was under review and in the hands of independent (barristers)," Mr Davis said.

"I asked them for a time frame and they said they couldn't tell me, they didn't have one, but they wanted to do it thoroughly. I just said we're not asking for much, and they nodded but couldn't say yes or no.

"Things have changed for the Bowraville folks but it took them 20 years so maybe it will take 20 years for us too.'

'Attwater, now living in Townsville, was charged with manslaughter and aggravated sexual assault.

His friend, Maris, of Wauchope in northern NSW, was charged with accessory after the fact to manslaughter and aggravated sexual assault. They were both served Future Court Attendance Notices to appear at Grafton Local Court on August 2.'

'An ambulance has been called to chaotic scenes outside a northern New South Wales court after two men charged over the death of Aboriginal woman Lynette Daley were granted bail.'

'Adrian Attwater and Paul Maris appeared in court for the first time since the charges were laid in June this year.

They were granted conditional bail in Grafton Local Court and had their addresses suppressed after their legal counsel told the court they feared for their safety.

As Attwater left the courthouse he was yelled at and jostled by angry family members, who chased him down the street.

One family member collapsed amidst the tousle and an ambulance had to be called.'

'The case was adjourned to next month.'

Lynette Daley death: Violence erupts outside Grafton court after first appearance of accused men

A crowd of around 50 of Ms Daley’s family and friends set upon Mr Attwater as he left court and walked to his car, screaming "hang, you dog" and assailing him.

One of Ms Daley's supporters collapsed and was taken from the scene by paramedics in an ambulance.


Mr Attwater's co-accused Mr Maris was ushered into the nearby police station and later escorted by officers from the area.

'Two men have pleaded not guilty to charges over the death of Lynette Daley on Ten Mile Beach, in northern New South Wales in 2011.

Adrian Attwater — who told police he was Ms Daley's boyfriend at the time — and Paul Maris had been on an alcohol-fuelled camping trip with the mother-of-seven when she died.

Today at the Supreme Court in Sydney, Attwater pleaded not guilty to manslaughter and aggravated sexual assault, and Maris pleaded not guilty to being an accessory to both counts.

Family and friends of Ms Daley burst into tears as they heard the pleas.

Daughters 'still traumatised'

Outside court, a group of supporters held banners calling for an end to violence against women.

Relatives of Ms Daley told the ABC two of her teenage daughters are still traumatised by their mother's death five years ago.'

'Attwater appeared in court via video link from interstate.

Maris enlisted the help of NSW Police and court security to leave the court house and avoid Ms Daley's supporters.

Making no comment to the media, he went straight to a taxi.

The men are due to stand trial on July 24 next year, but a location is yet to be set.

Legal representatives for both men requested the trial be held in Coffs Harbour.'

Her blood was everywhere: It was between her legs and on the remains of the recently burned mattress partly hidden in the sand. And it was on the jeans worn by one of the two men who were with Lynette when she died.

A coroner would later find Lynette bled to death from a sex act she was subjected to while so deeply intoxicated, she could not have consented. A forensic pathologist dubbed her injuries more severe than those which occur in even precipitous childbirth.

Yet for five years, despite the urgings of the coroner and police, prosecutors refused to try the men charged with her death. It was not until June, under pressure from an outraged public, that they at last agreed to bring the case to court.

Prosecutors have never publicly explained their reluctance to take the case. But Lynette’s parents believe the reason is both painful and obvious: Their daughter was Aboriginal. The two men accused in her death are white.

THE extent of Lynette 'Norma' Daley's intoxication at the time of a sexual act which allegedly caused, or played a significant part in the cause of her death on a beach north of Iluka, will be a key factor in the Crown's case against Adrian Attwater and Paul Maris.

Mr Attwater is charged with manslaughter and aggravated sexual intercourse without consent over the Clarence Valley woman's death, while Mr Maris is facing charges of aggravated sexual intercourse without consent and accessory after the fact to manslaughter.

Both have pleaded not guilty to the charges, and the two Supreme Court trials are running concurrently in the Coffs Harbour courthouse.

Yesterday afternoon, Ms Daley's mother and other family members and friends sat in the public gallery as Crown prosecutor Philip Strickland SC began his opening address to the court.

Mr Strickland explained to the jury that there would be "a lot of evidence heard" about the fact Mr Attwater, Mr Maris and Ms Daley drank a lot of alcohol on January 26, 2011, prior to the acts which allegedly caused her death.

The mother-of-seven's body was found on Ten Mile Beach in the early morning of the following day.

The New South Wales Attorney-General has issued a please explain to the Director of Public Prosecutions (DPP) over its handling of the Lynette Daley manslaughter saga.

Two men were yesterday found guilty over the 33-year-old's death, with a Supreme Court jury taking just 32 minutes to reach its verdicts.

Despite a thorough police investigation in 2011 and coronial findings in 2014 which strongly recommended charges be laid, the Office of the Director of Public Prosecutions did not prosecute the men.

The jury's swift conviction in the matter has led to questions about why the DPP waited so long to pursue Adrian Attwater and Paul Maris over Ms Daley's death.

An ABC Four Corners program about the case in 2016 sparked public outrage, so director Lloyd Babb SC called in independent counsel, Philip Strickland SC, who ended up bringing the matter to trial for the DPP.

Today NSW Attorney-General Mark Speakman said he had "spoken with the Director of Public Prosecutions and sought an urgent brief on the circumstances surrounding this case".

"I've also confirmed that the NSW Government will continue providing support for the family of Ms Daley during the sentencing process," he said.

The DPP told the ABC that as the matter was still before the Supreme Court "no comment can be issued".

Sentencing will begin on November 3.

'Just three months after Ms Daley’s death, he [Maris] was in Grafton Local Court where a two-year AVO was taken out to protect his then-partner. In all, four AVOs have been taken out against Maris between 2005 and 2015 to protect four women in Casino, Port Macquarie and Grafton.

Attwater’s convictions include resisting an officer in the *execution of his duty.'

JUSTICE is the will of the people.

It’s a proverb so simple and so common, I had actually found it once on a message in something as mundane as a Christmas cracker I had pulled one festive season.

But when it came to the heartbreaking death of Lynette Daley, it turned out that even a cheap mass-produced Christmas insert made more sense than a decision of the state’s top prosecutor.

Yesterday it took just 32 minutes for a jury to hand down the will of the people and justice for the dead 33-year-old mother. It was justice that Ms Daley’s family would never have seen if the DPP Lloyd Babb SC had his way.

When he took over the top job in July 2011, Paul Maris and Adrian Attwater had been charged by detectives over Ms Daley’s sad and lonely death on a north coast beach.

One of the first decisions on Babb’s watch was to drop the charges.'

'There is not enough evidence to establish that Mr Attwater committed the inlawful and dangerous act which led to Lynette’s death,” he wrote to Ms Daley’s family.

Not only was the young woman too drunk to consent to sex with the men, her insides had been ripped apart. The injuries left her bleeding to death. But that, according to Babb, was not a crime.

It was an inexplicable slap in the face for Ms Daley’s family and her seven children.

The young woman had already had a tough life.

Said by one of her sisters to be kind-hearted and wanting everyone to be happy, she had been a victim of domestic violence almost since her first boyfriend. “All Lynette’s partners used to belt her,” her sister told a 2014 inquest into her death.

After The Daily Telegraph revealed the shocking injustice that her attackers had gone free, the will of the people swung in. Public pressure led to charges being laid.

Lloyd Babb owes Lynette Daley’s family an apology.

They are unlikely to get one.'
