A crown Prosecutor has conceded its star witness in a high-profile murder trial, notorious conman Peter Foster, is likely to be “a difficult witness to control”

They are still arguing over whether or not this should be a judge-only trial. The lawyers want a judge only, the prosecutor still thinks a jury could hear this case.

It sounds, to me, as though the judge may lean toward a judge only trial.


LAWYERS prosecuting alleged wife-killer John Chardon have conceded prison supergrass Peter Foster could go rogue on the stand at the Gold Coast businessman’s upcoming murder trial.
Mr Kimmins today argued Foster had used “every moment” possible while giving evidence at Chardon’s committal hearing earlier this year to mention his former cellmate’s checked criminal past.
Ms Farndon disagreed, saying Foster’s motivation was more “altruistic”.

Justice Boddice ...... He said lawyers should not be forced to “walk on eggshells” during questioning to avoid a witness “blurting something out” but the credit of a person like Foster, who had a history of dishonesty, was a classic question for a jury to consider.

Justice Boddice has reserved his decision.
The trial is expected to be listed for a date next year.

Notorious conman Peter Foster has walked free from a Sydney court after being sentenced for using a false name to get an investor to spend more than $1.3 million on an offshore betting licence.

The 56-year-old, who arrived more than six hours late for his sentencing on Friday, had pleaded guilty to making a false statement with intent to obtain financial advantage.

Apparently Foster had food poisoning, and he was sentenced to time served already.


He was due to be sentenced at 9.30am on Friday, but his lawyer Justin Lewis handed up a medical certificate saying Foster possibly had food poisoning and had missed his plane from the Gold Coast.

In Central Local Court on Friday, Magistrate John Andrews backdated his jail term to when Foster first went into custody, imposing a minimum jail term which would have expired in July - meaning he has already served his time.
He also placed him on a $500, 12-month good behaviour bond.

THE ex-lover of missing Gold Coast woman Novy Chardon had no alibi for the night his former girlfriend disappeared, a court has heard.

The evidence in one of Queensland’s biggest murder investigations was this week aired during a pre-trial hearing in the Brisbane Supreme Court for the man charged with the woman’s murder her husband John Chardon.


Novy’s former lover Amir Talaei-Khoei, 36, earlier this week gave evidence via video link from the US, and told the court he had been involved in a sexual relationship with the mother-of-two while she was living separated, but in the same home, as alleged killer Chardon in 2012.

During cross-examination by Chardon’s defence barrister Tony Kimmins, Mr Talaei-Khoei said he had been in a relationship with another woman named Paloy before meeting Novy.

The court heard the pair rekindled their relationship after he and the Gold Coast woman split at the end of 2012.

Mr Talaei-Khoei said the relationship with Novy ended after a “mutual understanding” it wasn’t going to work because the woman was still in the process of separating from Chardon and had two children.

But the court heard Novy text Mr Talaei-Khoei several times in 2013 following their split, when he was trying to reconnect with his ex-partner Paloy.

The court heard he told police following Novy’s disappearance one of the messages he received was “about missing me and wanting to see me again”

Supreme Court Justice Martin Burns set the date of August 12 for the start of John Chardon’s four-week jury trial before Justice Ann Lyons, the Senior Judge Administrator.

This could be something interesting, apparently a pre trail hearing is a procedural matter bought about by an application by accused or prosecution.
