A crown Prosecutor has conceded its star witness in a high-profile murder trial, notorious conman Peter Foster, is likely to be “a difficult witness to control”
They are still arguing over whether or not this should be a judge-only trial. The lawyers want a judge only, the prosecutor still thinks a jury could hear this case.
It sounds, to me, as though the judge may lean toward a judge only trial.
LAWYERS prosecuting alleged wife-killer John Chardon have conceded prison supergrass Peter Foster could go rogue on the stand at the Gold Coast businessman’s upcoming murder trial.
Mr Kimmins today argued Foster had used “every moment” possible while giving evidence at Chardon’s committal hearing earlier this year to mention his former cellmate’s checked criminal past.
Ms Farndon disagreed, saying Foster’s motivation was more “altruistic”.
Justice Boddice ...... He said lawyers should not be forced to “walk on eggshells” during questioning to avoid a witness “blurting something out” but the credit of a person like Foster, who had a history of dishonesty, was a classic question for a jury to consider.
Justice Boddice has reserved his decision.
The trial is expected to be listed for a date next year.
