So .... due to Stilnox, vodka, and Phoebe's love of climbing and physical exertion, it was concluded that she decided to hop into the rubbish chute while throwing a bag of rubbish in? As a confused prank, as a sleepy joyride ... a 12-storey drop that she thought she could survive? :shakehead:

I'm sure that former Supreme Court Judge George Hampel and County Court Judge Felicity Hampel must be very happy that their son has been exonerated of any (direct) blame.


I also noticed this at the end of the article, regarding the judges' daughter.

Mr Hampel's sister, Kristina Hampel, earlier this month pleaded guilty to possessing cocaine and a prohibited weapon after an undercover police sting at her home.
Ms Hampel had no conviction recorded and was ordered to provide 200 hours community service.
Magistrate Franz Holze said Ms Hampel's early plea and the embarrassment to her family were factors in his decision to record no conviction.

'Top legal, forensic and police experts have cast doubt over a coroner's finding that young Melbourne woman Phoebe Handsjuk died from a "tragic accident" when she plunged to her death down the garbage chute of a luxury high-rise apartment building.

Coroner Peter White found Ms Handsjuk inadvertently fed herself feet first into the garbage chute while drunk and under the influence of sleeping drug Stilnox in December 2010.

The expert opinions form part of a six-month Fairfax Media investigation of the circumstances of Ms Handsjuk's death. The first episode of a six-part podcast, Phoebe's Fall, can be downloaded today.'

'As part of the 60 Minutes investigation, reporter Tara Brown looks at what happened inside the apartment, where broken glass fragments were found on the floor. Phoebe Handsjuk lived there with her boyfriend Antony Hampel.'

'Brown told news.com.au the family believe the police let them down.

“Their expectation that a death so unique and so bizarre be investigated properly is a fair one,” she said.

“They are dismayed and frustrated that potential evidence wasn’t gathered by police as they expected it should be,” she said.

“The police failure, in their opinion, means the circumstances surrounding Phoebe’s death will never be clear. They can never get that time back or the evidence that was lost or overlooked during that period.”

The family also feel let down by the coroner, who they felt should have delivered an open finding. This would have allowed police to investigate further if new evidence came to light.

Instead the Coroner chose to solve, what family considers a tragic mystery, based on inconclusive evidence.'

'“Now the case is closed with so many of their questions left unanswered,” Brown said.

She said the family would continue to fight for Phoebe.'

'It's December 2, 2010, and the concierge at a luxury Melbourne apartment tower is making her way to the garbage room.

She is looking for a broom. But something blocks the door. She gives it a shove with her shoulder and catches sight of a young woman lying in a pool of blood among the fallen bins.

The concierge panics, praying the body is a mannequin. Then she braves a second look.

Phoebe Handsjuk was 24. Complex and beautiful. She lived 12 storeys above with her boyfriend Antony Hampel, a son of Melbourne's legal establishment.

But on that night, Phoebe died the most horrific death.

She had plunged 40 metres, feet first, down the garbage chute.

She survived the fall. But the garbage compactor at the bottom had virtually severed her right foot. Phoebe bled out in the dark, alone, her jeans around her knees.

But how did she get into the chute? And why?

The Coroner decided she had climbed in herself. He recorded death by misadventure. But there were no fingerprints at the top of the chute, and no CCTV footage. Her family doubts the Coroner's version was even physically possible.

The mystery remains.'

Secret tape gives insight into Phoebe Handsjuk’s battles before she died

'A SECRET tape made just after Phoebe Handsjuk’s death reveals the real monster in her life.

According to her partner, it was alcohol.

While it still doesn’t provide any answers into what happened to her when she fell down the rubbish chute at her exclusive apartment building, it does offer insight into what she was battling.

Released by The Age, the secret tape was taken by Phoebe’s mum Natalie, who recorded her daughter’s partner Antony Hampel.

“The hardest thing is that she didn’t want to die, she really didn’t,” he said in the recording.

“It was just that monster was the alcohol, you know. She was coping with her depression, she really was. She was with the best doctors and the best therapist. Every day ... alcohol, she couldn’t ... just brought out this monster and the monster won.”'

Growing concern over a Victorian coroner's finding into the mysterious garbage chute death of Phoebe Handsjuk has sparked a push for changes to the law.

Victoria's state opposition has pledged to amend the Coroner's Act to broaden the grounds for appeal; shadow attorney general John Pesutto says Ms Handsjuk's case highlighted the need for "confidence in our coronial system".

"The coronial findings in this case are difficult to comprehend and many Victorians will appreciate why Phoebe's family continue their painful search for a better understanding of events leading up to and following her tragic passing," Mr Pesutto said.

He said it was possible to increase the scope for grieving families to appeal controversial findings without opening the floodgates.

"Difficult cases like this are compelling reasons for having a broader right of appeal against coronial findings," Mr Pesutto said.'

Remember very little about the circumstances of this case. What tweaked my interest was Stillnox....this medication was suggested and prescribed to staff within aviation. Normally stillnox will put you to sleep within minutes and will have no hangover effect in the morning......unless of course you combine it with alcohol.
