Former Jetstar pilot Greg Lynn has lost his bid for bail as he awaits a retrial for the alleged murder of an elderly camper.

The 59-year-old made the bid for release after the Court of Appeal quashed his conviction late last year.

His defence team argued that the "exceptional circumstances" of the case meant Mr Lynn should be bailed to live with his son, who volunteered to put up his life savings as a surety.”

This is about the prospect of a permanent or temporary stay in the re-trial. (at the defence's request)



In a 13-page judgment, Justice Beach turned his mind to Mr Lynn’s prospects of receiving a stay when considering if there could be further delay to the proceedings.

“In my view, the prospects of the applicant obtaining a permanent stay are remote,” he said.

“The question is more difficult when one considers his prospects of obtaining a temporary stay for any and what period of time.

“Much is likely to depend on whether he is the subject of any (and if so what) adverse publicity between now and the time at which he makes his application for a stay.”

Justice Beach said he had not been persuaded that Mr Lynn’s trial couldn’t be held in the second half of this year.

Lynn showed no obvious emotion when the decision was handed down, turning in the dock to look over his right shoulder to Geordie and his wife, Melanie.

He again turned to look at them and gave them a smile as he was led out of court.

Interesting point that. Pilots usually require annual testing of health (based on age) and proficiency based on class of licence and any licence endorsements.

With Lynn being banged up, I guess he'll likely not be complying with those requirements.
Yes, that’s certainly true for commercial and he did work for Jetstar/Qantas. Does it apply to smaller aircraft licensing?

Simon Gittany got bail (for murder) for exceptional circumstances. The exceptional circumstances were that he was needed by his defence team to form his defence. :rolleyes:


"Crown prosecutor Mark Tedeschi QC had first pressed for bail to be revoked on Thursday afternoon.
Trying again on Friday, Mr Tedeschi said the exceptional circumstances under which Gittany's bail had originally been granted no longer existed.

But defence barrister Philip Strickland SC said the Crown's applications were premature and Gittany was still needed to help them prepare their case."

It’s hard to believe the justice system is doing its job when Gittany, Lynne, etc, dare to apply for bail, cases overturned on appeal, etc. I thought he was locked up for life, like Lynne. Both middle class monsters.

‘Remote’: Blow for pilot before murder retrial​



Following the ruling, Mr Lynn was in hushed discussion with his legal team before custody officers moved in to remove him from the courtroom.

Walking out the door, he turned to meet his family’s gaze, offering a short nod before exiting.

Following a trial in 2024, Mr Lynn was found guilty of Ms Clay’s murder but acquitted of Mr Hill’s. He had pleaded not guilty to both counts.

He is next expected to appear in court for a directions hearing on July 29.

I think that's what he truly wants people to believe but something tells me that's not what he knows as being the truth.
