Former Jetstar pilot Greg Lynn has lost his bid for bail as he awaits a retrial for the alleged murder of an elderly camper.

The 59-year-old made the bid for release after the Court of Appeal quashed his conviction late last year.

His defence team argued that the "exceptional circumstances" of the case meant Mr Lynn should be bailed to live with his son, who volunteered to put up his life savings as a surety.”

This is about the prospect of a permanent or temporary stay in the re-trial. (at the defence's request)



In a 13-page judgment, Justice Beach turned his mind to Mr Lynn’s prospects of receiving a stay when considering if there could be further delay to the proceedings.

“In my view, the prospects of the applicant obtaining a permanent stay are remote,” he said.

“The question is more difficult when one considers his prospects of obtaining a temporary stay for any and what period of time.

“Much is likely to depend on whether he is the subject of any (and if so what) adverse publicity between now and the time at which he makes his application for a stay.”

Justice Beach said he had not been persuaded that Mr Lynn’s trial couldn’t be held in the second half of this year.

Lynn showed no obvious emotion when the decision was handed down, turning in the dock to look over his right shoulder to Geordie and his wife, Melanie.

He again turned to look at them and gave them a smile as he was led out of court.
