I didn't realise that Russell's daughters sat in court and had to hear the terrible news about the appeal.

Mr Hill’s daughters, D.. and C.., sat in court and appeared emotional as the decision was handed down.

I think it was said before that the Clay family was crying quietly.

Former pilot has murder conviction overturned

Ms Clay's daughter Emma Davies and Mr Hill's daughters Deborah and Colleen appeared emotional as the decision was handed down.

Former Jetstar training pilot Greg Lynn will remain behind bars ahead of a new trial over the death of a elderly camper.

The 59-year-old hunter appeared in the Victoria Supreme Court on Wednesday morning for an administrative hearing after his murder conviction over the death of Carol Clay, 73, was overturned last month.

Due to legal reasons, the discussions between prosecutor Mark Gibson KC, defence barrister Dermott Dann KC and Judicial Registrar Tim Freeman are unable to be reported, however Mr Lynn was remanded into custody to return to court in July.

During Mr Lynn’s appeal, his barrister Dermott Dann KC submitted there should not be an order for a retrial.

The three Court of Appeal judges found the “interest of justice require a new trial”.

“There is a powerful public interest in ensuring that a fair trial is held for alleged wrongdoing of this high order,” the judges wrote.

“There is no reason to think that the fundamental unfairness which permeated the first trial will carry over to the new trial.”

I know there are such things as coincidences, but . . . if Greg Lynn gets away with this, and all the other things in his past, I will probably explode. And what about that thing called "the balance of probabilities"?

Permeated (i.e. spread throughout) the first trial? Those appeal court judges are nuts, IMO.

IMO, the fundamental unfairness of the first trial is that Lynn was not found guilty of murdering both people. Hopefully the second jury is smarter.
