Why blame the judge though?
I don't think you can say that a trial was permeated with unfairness without it being a reflection on the judge. The judge is there to control proceedings so that the accused is fairly tried.

If prosecuting counsel repeatedly ignores the judge's directions, is there anything short of declaring a mistrial that the judge can do? Perhaps declare counsel in contempt of court? What would happen then? Would the case continue as before or would counsel be replaced? Or would the contempt issue necessitate mistrial anyway?

"A trial permeated with unfairness" - ha! So says his defence and 3 judges?! Do they really think that it's ok to kill 2 people and then try to wipe their remains off the face of the earth? (And yes, this much he admits to). Even if they can swallow the obvious lie that the killings were both accidental. "No no, Greg, of course you haven't done anything wrong, people can be so unfair." How about being fair to the victims? As you can probably tell, I am incandescent with rage!

I think it's more important that the State abide by fair procedures than that an individual be punished even for murder. The State potentially can do a lot more harm than one violent man. (But lock GL up forever, that too.)

The Appeals Court (Karin Emerton, Phillip Priest and Peter Kidd) blamed/faulted the judge.

When Croucher began his long summing up, I commented here that I thought he was telling the jury to acquit, however, towards the end I figured that he was just exercising an abundance of caution to avoid a mistrial.

I've wondered about this... rather than the judge asking the defence mid trial if they would think a mistrial is necessary after noting all the errors that were being made by the prosecution, why wouldn't the judge just call it himself?

JMO...
Keeping in mind the fact that all criminal trials are designed to favour the accused, having the judge order a mistrial would be favouring the prosecution. There was still a chance GL could be acquitted of both murders, so taking that possibility away from him would be prejudicial.

Accused High Country killer Greg Lynn will seek to be released on bail next week after his murder conviction was overturned on appeal.

On Friday, Mr Lynn’s solicitors at Chris McLennan & Co revealed an application for bail had been lodged with the Victorian Supreme Court.

This has since been confirmed to have been listed for 9.30am on Thursday, February 26.

So in 6 days he could be out on bail. I am so sad for Russell's and Carol's loved ones. They have been through enough. And now this person who burned and bludgeoned Russell's and Carol's remains, as if they were rubbish, refuses to accept any consequences.

Exactly. And aren't they worried at all about what he might do while free on bond? Can't see how they seem unconcerned with the safety of his community as well as himself!

This just seems like a very bad idea.

The scales of justice have tipped in Greg's favour recently. Its time for things to even out a little.

I'd say the chances of him getting bail will be very low. But hey, I've been wrong many times in this case.

I hope it can still be argued that GL poses a danger to society, for just the things that he has admitted to have done.

I was looking for info about that yesterday. All I could find was VicPol stating that there is enough evidence for an inquest into Lisa's death. There wasn't an inquest previously. The coroner just decided that Lisa had died from drugs and alcohol.

The articles that said that VicPol were launching an investigation into Lisa's death are now taking me to a 404 error, page not found, like the link in this post. And like another article by 7News that is now gone.
