First time poster thought I would start with something helpful. The answer to this question is no - self induced intoxication is incapable of constituting a complete defence. Although it is capable of going to capacity insofar as intent is concerned. I.e. a drunk person who kills another may be found guilty of manslaughter not murder if the jury accept he was incapable of forming the requisite intent to kill or cause grievous bodily harm. This is because intent is an element of murder. Very very rare though.

Lack of capacity in criminal cases where there is a comorbidity is a complex issue. In very simplistic terms, unsoundness of mind (in terms of not being responsible for a criminal act - a matter determined in the Mental Health Court (Qld)) is a question of whether, but for the ingestion of drugs or alcohol, a 'disease of the mind' would have still been capable of causing automatism aka lack of capacity. So theoretically amphetamine induced psychosis, if that occurred independent of any proximate ingestion of speed/ice, could result in a finding of unsoundness of mind. It is very very uncommon though.

Thank you. I get a feeling that this is what RB's legal team will build his defence on. I would also imagine they will try and stick the knife in AD. Just my opinion though.

I wonder if it was a joint enterprise or one just helped mop up so to speak - it happened in rb's house but ab may have committed the murder with rb an accessory - still culpable of course - will be a fascinating trial

For not being able to positively identify the remains yet, they sound extremely sure it is Sam. Just the formalities to go through, no doubt.

Sending strength to Sam's family. What a nightmare they are living through right now.

A BODY has been retrieved from a shallow grave in a forest near Caboolture, as the Samuel Thompson murder investigation continues.

“The gravesite is yet to be exhumed, but scientific officers will now commence that process,” Detective Inspector Tim Trezise said at the crime scene.
“There could be more than just Sam’s remains there. There might be other things there in terms of evidence so they will collect it as they go along.”

Looking at Sam's FB page...it appears that he was on good terms with his Mum Debbie and Dad Bruce as shown on their FB pages with pics up until his disappearance...

The family all live in Brisbane area...At one stage Sam was looking for a room to rent on his FB page just before he took the unit at Albion where he was living when he disappeared...

As Sam appeared to be great mates with his Dad
Bruce (they used to go to concerts together etc), I cannot come to terms with why his Dad couldn't have stepped in and coaxed Sam away from those undesirable mates he was associated with (drugs)...After all, Sam was only 22 years of age when he was killed...

Wouldn't his Dad have wondered where all the money was coming from for Sam to have such expensive cars, designer brands and expensive overseas holidays...If it was my son I would certainly want to know...

I mean to say why would a father not do that to save his son's life, as life is so precious...It's not as though they were living in seperate towns, as it was Brisbane area...

Sam was an unemployed childcare worker...His father must have known about the destructive life Sam was living...It makes me very sad that Sam had to lose his life this way...He should still be alive today...MOO

I really believe his parents must have had suspicions on what he may have been caught up in given the quick amount of time he was reported missing and when his disappearance was all over the media. In saying that Kids will only let parents know so much and be involved in so much. Like Sams Dad said, "he did things his way". Sometimes parents won't get too involved in fear of losing a relationship with their kids. Maybe they didn't see how deep he was in it as he was still functioning fine and living what seemed a 'good life'. I would imagine right now they are overcome with grief and wishing hindsight was a reality.

BBM: They probably hoped that they were quick and public enough to save Sam's life (or at least his physical wellbeing) from the truly sad and unfortunate fate that had already occurred.

I recall Sam's dad saying that Sam didn't seem afraid after the home invasion, and in the next breath saying that Sam moved immediately afterwards.

I'm not sure that any of us knew for sure what Sam was dealing. Just someone had said that RB's behaviour was escalating due to overuse of ice and cocaine.
We just saw a few veiled references on Sam's FB page that could have meant anything in that industry, I suppose.

So far we have not read of any drug charges on the perps. If they were found to be dealing in drugs the police may have suspicion of the whole crime as to why Sam was killed, but perhaps are not able to prove anything to do with drugs. Their charges right now are Murder & interfering with a body. And police have stated about no other charges i think?
And unless they have been drug tested initially, that may not be a provable fact either.
We will just have to wait and see what happens in court.

He may of well been caught up in that as well I'm not sure.. I do know he was doing deals over $60k. I reckon these guys just killed him for the money. But friends of AD said he was also a drug dealer. I would never of thought Pot would get you killed but just goes to show ALL drugs are bad. I worked at AD doctors surgery too 😕

IMO There is never an excuse for murdering someone, no excuses to my way of thinking.
And if that were my child, those two better run for the hills.

So, would i be right to assume the timeline of events goes something like this,

ST leaves his apartment, drives to RB's, gets murdered, they move his car to deep water bend or what ever it is called, they then dump his body in the forestry.
They then go back and drive his car from deep water bend to northern New South Wales with AD following in his white chrysler ?

I would find it very hard to believe that dealing pot would amass that much money. I would believe that he may have told friends and family that he was dealing pot. i have known pot dealers in my time and not one of them had a flash lifestyle like that.
