When has being let out on bail EVER been an indication of someone's innocence when charged with murder? When has it EVER indicated that the police don't believe a person actively participated in a victim's death, when the charge is murder?

What's been reported widely is that police don't believe Tostee was on the balcony when Warriena fell.

As it happens, neither do I.

I have a different theory about O’Gorman.

He was at his wits end as to what to do with a client who posted a lengthy post on the bb forum claiming his innocence. A client that also provided a link to the suppressed audio recording in that post. A client who probably posted the audio recording onto the Canadian site himself, or had someone do it for him, as I feel pretty sure that neither the police or O’Gorman did that.

O’Gorman is very against trial by media. He doesn’t like the media publishing trial items prior to trial. I’m thinking he was probably pretty darn unhappy that Tostee posted trial information prior to the trial.

And that is what I think happened to O’Gorman. Especially given the timing of the break in his business relationship with Tostee. He threw the case back at Tostee. Or Tostee got upset at O’Gorman dressing him down about the whole mess, and he found another lawyer.

Did Julie Frost encourage Tostee to post the info? And/or did O’Gorman find out she had been blabbing on social media? Possibly. She certainly did something to cause him to expend the time and effort to lodge a complaint against her with the Legal Services Commission. Something that went against his (and legal) principles imo.

This was my line of thought on this as well. I saw that post and thought, 'O'Gorman's gonna crap' as there would obviously be a total media circus, never mind whatever damage was done.

BBM Really? These are two I remember off the top of my head. I can give you many more examples even though I know they have been provided to you before when you posed this same question.

Because the law has a different view of a perpetrator of a crime of passion. Its different than a murder between people whom are not intimate. It is recognised there is a greater propensity for aggravated behaviour between intimately linked people. Those perpetrators are not viewed as a danger to society as an otherwise cold blooded killer, and they usually make bail if they have a stable life (job and domicile). Their charges are reduced form murder to manslaughter usually on application by the defence.

By the way, this is not an opinion, this is what Qld law states.

It is common for those accused of manslaughter to receive bail. The judge deemed this to be the more appropriate charge for the purpose of assessing bail. It would have been unconscionable to remand a person on a weak murder charge, epscially when it appears the victim died from her own actions, and not at the hand of the accused.

The investigation is on going and not definitive.....

Barrister Tony Kimmins for Tostee said his submission was it would be a prima facie case in relation to manslaughter, as opposed to murder.
But Justice Mullins said "It made little difference to the bail application."
The reality is, sentences for manslaughter are significant, so the same issue about flight risk......

His poor family will be mortified by his behaviour because it reflects so badly on them. They don't appear very wealthy. This could ultimately cost them their livelihood, at the end of their years all they have to look forward to is prison visits for the next however many years. Dreadful dreadful behaviour by an almost 30yr old. Immaturity and then some. You might just as well say he ruined their lives too.
So I wonder all up the number of people he's traumatized, harmed, defrauded, killed and almost killed by his reckless drunken illegal impulsive behaviour?

I just realised, it was a year ago that Tostee was arrested for assaulting and obstructing police, then he continued going downhill from there.

This proves my point. The allegation was that he obstructed, not assaulted. The name of the charge happens to contain both terms. He has not been convicted for this.

I wouldn't say he snapped at any point. His tone was very calm up until he raised his voice slightly near the end after WW apparently tried to assault him with whatever he tried to make her let go of.
