You've got that difficulty that although theoretically your client wasn't on the balcony, it makes the murder case a little bit more difficult...............................................
But I would have thought it is a reasonably strong case for manslaughter on the material as it stands at the moment...................

The investigation is ongoing, so it's hard to be definitive.

I'll admit I struggle with this. Does anyone wonder if LE spoke too hastily about GT not placing her over the balcony? The positioning of Rrie's feet may not have been enough evidence to confirm it, perhaps?

But I don't believe it is pointless for us to discuss it here, Bicept.

It's what the prosecution alleged at the initial bail hearing as well as the one a couple of months after.

Witnesses saw her climbing over.

As for the witnesses who saw her climbing over, I believe there is only one witness who made that exact statement correct? I've always taken that to mean she assumed her to be climbing over, since she could only see her legs and not if someone was on the other side of the balcony.

Regarding the audio, I have a different theory on that but I don't believe we are allowed to discuss that here are we?

ETA: Not sure if you would be interested in hearing my theory anyway since it doesn't jibe with what prosecution alleges...it's just my own personal theory.:)

No witness that we know of saw Tostee on the balcony or suggested that he had any role in WW going over the balcony.

The prosecution states that she climbed over while Tostee was inside, and that is what they are proceeding with, so any alternate theories have no bearing on the reality of the matter or its outcome.

The public denial is almost comical isn't it? We're expected to believe the media feels free to make up any old crap about "two leading law firms with the Legal Services Commission", and they'd just let that slide. Okay, brah.

Or... maybe the Legal Services Commission, as well as his former lawyers, are just out to get him too, now. :waitasec:

A complaint about Julie Frost does not mean she had anything to do with Tostee's choice of lawyer.

As for the media "making stuff up", it happens literally all the time.

Again, a complaint about her involvement doesn't mean she caused Tostee to switch lawyers. Why would he take advice from her? Didn't he block her on facebook? The complaint could have been instigated by Tostee himself after she tried to contact him.

The article is vague. Who exactly accused her of becoming a "wedge" if neither Potts or O'Gorman responded to comment? It doesn't tell us who. How exactly would she have caused Tostee to split with a lawyer?

Why would Tostee publicly distance himself from Julie Frost unless he didn't appreciate her involvement?

Besides, it wouldn't be the first time the GC Bulletin has made stuff up.

If you'd bother to read the rest of the thread, there's a link a few pages back that I can't really discuss because it's not mainstream media, pertaining to the issue of Frost giving legal advice to Tostee's family. In her own words.

"Detective Superintendent David Hutchinson of the Gold Coast CIB told APNZ screams were heard at the unit "shortly before the fall" at 2.30am on Friday. "There was a disturbance in the unit, there were raised voices."

Police had obtained statements from nearby residents who witnessed and heard "certain things". Mr Hutchinson would not go into further detail."

There is nothing illegal about taking free advice from a law student, or anyone. I'd say perhaps as a law student, Frost may have broken a minor ethic only in giving continuing advice to someone who had engaged a legal practitioner. This is what I think the interference is .

My guess is OGorman is motivated by spite, because he lost a high profile client that was going to make him a lot of money, and give him some fame, and well as a feather in his cap for an easy win.

But why is this even being discussed? IT has nothing to do with the charges at all, its a total side issue.

Why is the accused out on bail if people witnessed certain things? I guess they didnt witness anything substantial? And where can anyone observe that balcony from it seems to be out of view of everyone? I think all they witnessed was the fall.
