Justice Byrne is instructing the jury: the audio is the evidence, not the transcript. Transcript is an aid only.


Just for reference....there hasn't been an Audio recording presented to any court in Australia, from the Magistrates Court, to the County Court, to the Supreme Court, and including the Family Court, that hasn't been accompanied by the corresponding Transcript, since 1982, when the High Court made it mandatory.

Trying to get mileage out of an audio recording being paired with a transcript of the recording is taking redundancy to it's outer limit. It has always been the position of every court in AU that the audio is the evidence, the transcript is the aide-memoir. Nothing new here, as most folks would be aware.

If you had been following the case, you would be aware that the early transcript doctored up by Police to hang Tostee and prejudice his bail application was full of errors. Justice Byrne was most likely referring to this when he made that point.

Less than a minute after Warriena falls, seconds really... Tostee says "sh_t" and "where's my keys".. around this time on the recording you can hear him unscrewing something heavy and metallic, and something goes "thud".

The he leaves in a hurry -- what was *important enough* for him to stop and fiddle with in those moments before he bolts out of the apartment?

Just a very few mins later, he's in the car making up LIES about how she got onto the balcony -- 1. he admits to pushing her out there, 2. he says she ran out there, 3. he says he can't recall how, "last he remembers" they were on the floor.

CYA from the second she fell. No concern for her, whatsoever. AND he makes sure to record it all?

I think he does a great job of hanging himself out to dry, personally.

No, I don't agree that Warriena was physically violent towards Tostee..

<mod snip> he presented to a doctor the next day and welts and abrasions were recorded on his body. She certainly inflicted more than casual damage on him. <mod snip>
