It seems that costs are not paid by the losing party on numerous occasions. There are examples of this in a NSW govt publication.

... courts in defamation proceedings have often been reluctant to enforce provisions to impose costs on an unsuccessful party who had prolonged a trial by deliberate faze allegations, or continued proceedings where there was obviously no hope of success ....

No need to get excited. I think that Spedding's case is not over yet. From what we have been following, one of the cases is slated to go to a jury hearing, if he wishes.

Also, that is not the only situation in which costs in a defamation case are not paid by the losing party. Please read the link. That is what links are provided for ... by most people.

ETA: The link you later added is not specifically about defamation costs. The link I provided is.

Oh are you in America with papertrail? I didn’t realise, sorry, otherwise I’d have specified that I was speaking about Australia. My apologies- systems are different all over the world. I just assumed (obviously wrongly) that you are based in Australia
That explains so many misunderstandings.

The tragedy is, the working class in Australia can’t afford legal representation. You either have to be on what we call the dole (money for not working) or very rich. Us middle class just have to grin and bear it, so to speak. And subsidise those on the dole (pensioners sure. Do deserve this service, though). Yes another topic for another day, but certainly relevant to Spedding.

Sorry I don't understand your assertion that I am in America. With respect I am not.

MS looks at husband like she’s not quite sure so I wonder how sure she is these days and if/when she is questioned at the inquest will she be more ‘confident’ than she was in this clip.

@ 1:00 why the 8 seconds before he could answer if he was at the Tyrrell property and even then he did not answer the question. MS looked like she wanted to know the answer as well. IMO of course.

Doesn't seem to matter if she is sure of him or not. But I hope that once she is isolated on the stand, any cracks in her story start to show.

Sometimes I wonder if Margaret is like some US presidential wives. "You must come with me to show your support". Because I am not sure why a man would drag his wife through the media scrums of his child sex charges. It can't be good for her (in her small community) to be on full display in the media like that.
In my way of thinking, a real man would leave his wife at home to protect her - and just walk with his lawyer, or by himself, to and fro.

I don't think she needs protecting. I think she's in her element showing how supportive she can be. She probably prefers him when he's in trouble. JMO.

Have been reading various missing person cases examined by the NSW Coroner and the below para is always included in the beginning stages of the report. I note the words clear, cogent and exact. The reports are on the NSW Coroner website.

Given the seriousness of the finding, it is well established that the court should apply the Briginshaw standard.

The proof of death must be clear, cogent and exact. At common law, there is a presumption in favour of the continuance of life however, it is not a rigid presumption and the circumstances of any given case must be carefully examined before a finding of death can be made.
Hi PT, I think that was from the link i posted up and have been reading of the CI's and the Coroner's findings on that website too. Just the cases on there of missing presumed deceased, and did you read the one about the guy that had been through a criminal Trial and was acquitted, and then the Coronial Inquest? It was interesting how the police set him up too. Here is the link if you want to read it if you haven't already.
