, is requesting to be heard in the closed court when the Magistrate hears background on the grounds for a suppression order. The Crown opposes the appearance from the media representative.

You would think "the Media" could afford a Barrister to put forward their case, rather than a solicitor?? unless perhaps incorrect use of the term?? ha ha

In startling scenes, Magistrate Hudson blasted the NSW Police Commissioner’s legal team for failing to prepare for this morning’s hearing.

“I’m going to give you 15 minutes to sort this out,” he said.

“It’s despicable. You are stopping somebody getting their hearing, when they have waited since September.

“I want concrete answers, not feeble excuses.

“This is burning court time.”

Mr Jubelin is charged with several offences under the Surveillance Devices Act, related to the five-year investigation into the disappearance of a three year old foster child, William Tyrrell. He denies wrongdoing.

The morning started badly for everyone, with the case assigned to a tiny courtroom on the fourth floor of Sydney’s Downing Centre, a space far too small to accommodate all of Mr Jubelin’s supporters, plus all the counsel, and media.

The trial was moved to a more cavernous space, but the NSW Police Commissioner’s barrister, Rob Bhalla, then rose to say that he wasn’t ready to proceed, despite this case being so high-profile and important – a former detective accused of misconduct in a case involving a missing foster child.

The problem, he said, was trying to find an assistant commissioner of NSW police “who is not conflicted, given the nature and previous role of the defendant.”

This article is pretty WOW!! Good on the Judge for being so direct! I personally think the Inquest needs someone like that …… rather than using the approach of Mr Craddock.... but that is my opinion only...

How can they not be ready??? and not advise the Court of this until this morning....??? The mind boggles!! IMO

Some of those suppression orders cover the police work done to date; others are related to William’s status as a foster child.

The suppression orders, as they stand, mean that some information can’t be shown even to the magistrate in Mr Jubelin’s trial.

Mr Bhalla told the court that the NSW coroner handling the Tyrrell matter, Harriet Grahame, was unable, due to other commitments, to vary those suppression orders on Monday.

It was soon revealed that Mr Bhalla’s team had not been in touch with Ms Grahame until last Friday.

“It was by oversight, I must admit,” Mr Bhalla said.

“We didn’t become aware (until last week) that they (the suppression orders) are so restrictive, that we couldn’t show them to your honour,” he said.

Mr Bhalla pleaded for understanding, saying: “I can’t say why she (the coroner) cannot do it today. It’s a personal reason. She cannot vary the order until after 4pm. No amount of phone calls from me is going to change it.”

Literally on a roundabout. Both can’t proceed without the other.

I feel a closed court is on its way - which will restrict open justice.

If the magistrate can’t even hear the suppressed matters...... where do you go from here!

Surely the coroner, magistrate and crown should have consulted with each other from the beginning on the legalities - being a matter of interest for all involved.

Why can't the coroner vary the orders until after 4pm today?

I don't know , there could be a lot of reasons I guess.

BTW I don't see hear varying any of her orders..........

This is quite a complex issue.

Should just close the court & get on with it IMO
