I can understand the Magistrates frustration :eek:

When I looked at the court list recently , this case was listed as a "special fixtures" , which basically means that the case was pushed forward to be dealt with in a timely manner ( for whatever reason, maybe hoping it would be finalised before the inquest starts again? )

[A202.185] Special fixtures Some cases have an element of urgency about them, and the court can be requested to guarantee that a matter will definitely start on a particular day. This is known as a special fixture. You will have to be able to address the need for a matter to be given such priority. Typical reasons are that witnesses have to travel from the country (or from interstate or overseas), expert witnesses need to be called, or one of the parties or witnesses has pressing health problems. Give the Bench the reasons for asking for a special fixture at the time you make the application for a hearing date. The special fixture fact will be noted on the court file cover.

It stinks. Even GJ being stuck in the lift makes me suspicious. Someone is trying so hard for this info not to come out. I wonder what there is to hide?

I can't really say the same for the cops, this case against Gary smelt rotten from the beginning :rolleyes:
I think it's more than that. There is info in those tapes that should be public perhaps?

Either way certain cops don't want themselves to be exposed , it'll all come out in the wash ...........I hope :rolleyes:

I'm sure Gary is having a private chuckle at how incompetent they are looking right now :D

This is probably a very dumb question.
Is that anyone of the NSW Police assistant commissioners that can sign the required statement? Or is there just one NSW Police assistant commissioner that was/is able or responsible for signing documents to do with secret evidence?

Good point Soso .... you would think if they can’t find an assistant commissioner to sign it off then the actual Police Commissioner would be able to do it??? As they should be above all “conflict of interest” or bias to even hold that position....

Seem it has been sorted.

Prosecutor Phillip Hogan said the information sought to be suppressed was "fundamental to the Crown case".

The hearing was briefly adjourned as lawyers acting for the NSW Police Commissioner scrambled to locate an Assistant Commissioner to swear a document and struggled to find a stapler.

Magistrate Ross Hudson said the Crown Solicitor's Office had more than two weeks to organise the suppression it sought but instead "sat on their hands". He described the delay as "despicable" and said he wanted an explanation for wasting the court's time, not "feeble excuses".

I think "conflict of interest" is about a person's situation and not a reflection of his/her probity. So no, I don't think anyone is above that test.

Mr Jubelin's barrister Margaret Cunneen, SC, said she strenuously opposed the prospect of a closed court.

"There must be open justice in this case," Ms Cunneen said. "Surely the application for suppression must be about specific parts of the evidence, not the whole proceeding."

Ms Cunneen said her client "has always indicated to the NSW Police Force the difficulties, the effect that these proceedings would have in derailing the Tyrrell investigation".

"It was not he who put all of the information about the allegations about him out in the public before he was charged," Ms Cunneen said.

Yes. Most likely all the assistant commissioners (and the commissioner) so far have refused to sign claiming conflict of interest.

I think there was some deliberate delay to try to conceal their disorganization, which Jubelin implied was due to unprofessional laziness, and the disorganization is causing further delay. The only reason I can see for them deliberately delaying beyond that, is if they know they don't have a case and want to keep Jubelin hanging for as long as possible. I wonder.

I think it’s time they all got their act together, my fear is the inquest is not going to go ahead either at the stated date.
