9/26/24 Update: The Arizona Supreme Court will listen to oral arguments on Thursday, 9/26/24, where each side will get 20 minutes to speak. Oral arguments over a key piece of DNA evidence in a 2015 murder case. Feldman was found murdered in her Scottsdale home over nine years ago. Her case marked the first in Arizona where familial DNA was used to help track down a suspect. But all these years later, Ian Mitcham's trial is on hold as the battle over DNA evidence continues. One judge tossed out Mitcham's DNA sample & said it couldn't be used as evidence because it was collected as part of an unrelated DUI case. But then an appeals court reversed that decision. Now the Arizona Supreme Court will listen to oral arguments.

PHOENIX - The Arizona Supreme Court is taking up a case on Thursday which will have a major impact on a Valley murder investigation, and possibly many future cases.

During a hearing on Sept. 26, the supreme court heard arguments on evidence used in the Allison Feldman murder case, which was the first time familial DNA was used by police to link a suspect to a crime.

Last year, just before the case was set to go to trial, a judge tossed out the DNA evidence. The defense argued that using the sample violated Mitcham's Fourth Amendment rights because he didn't consent to it being used, and it was supposed to have been destroyed.

The Arizona Court of Appeals later reversed that decision, which led to an appeal to the state supreme court.

Lawyers from both sides were given about 20 minutes to present their cases during the hearing on Sept. 26.

The 31-year-old's murder rocked the Valley, but the case went cold until 2018. In April of that year, law enforcement announced they had arrested Mitcham.

It was the first time Arizona used familial DNA to lead police from the crime scene to the suspect. In Mitcham's case, his brother, who was already behind bars, matched as a close relative.

The Arizona Supreme Court listened to oral arguments in late September. Mitcham's attorneys had argued that the DNA couldn't be used because it shouldn't have still been in the DPS system. Ultimately, the court ruled Tuesday that the DNA taken during the police case can be used.
