The Court finds the State has met its burden providing sufficient evidence on the matters of homicide & premeditated homicide from which a Jury can make a determination. Accordingly, for this and for all of the reasons set forth on the record.
IT IS ORDERED denying Defendant’s Rule 20 Motion for judgment of acquittal. Court and Counsel address Final Jury Instructions. Court and Counsel address the form of Verdict.
The State objects to the lesser included offenses of Manslaughter and Negligent Homicide.
IT IS ORDERED the State’s objection to the lesser included offenses of Manslaughter and Negligent Homicide is overruled. Defense starts their case on 4/10.
