I have been doing some reading about this case and I am coming up with more questions than I have answers. I don't think this case is a slam dunk for either side.
1) Why was RC arrested and charged that afternoon before an investigation was completed?
2) why didn't Virgillo stop RC when he saw things escalating?
3) If DR was calm, why did they use pepper spray and have to taser him?
4) If DR was calm, why were both officers trying to get ahold of DR arms?
5) Dogs usually bark when they are excited, nervous or as a warning. Wouldn't the dog barking indicate that some kind of commotion was going on?
6) RC put his gun up to DR temple per Virgillo that left a bruise according to ME. Why didn't Virgillo call for a supervisor or officer needs assistance once that happened?
7) DR was shot twice in the chest and the bicycle was found on top of him. Wouldn't the bicycle have been a barrier between RC and DR, thus giving Virgillo's account of what happened more credence?
8) Why was Juan Martinez assigned to this case? Was it because he is Hispanic and the anti-Hispanic climate?
9) Why wasn't RC offered a plea deal? Initially, most of the people surrounding this case thought he would be given 3 years probation. It didn't happen.
I was reading other LE reaction to this case on Officer.com and Police 1. Many of them had questions similar to mine. Most of the comments were not thinking that this case would have a positive outcome for RC based on the info that has been released. However, some have said the defense has poked holes in the prosecuter's case. It will be interesting when/if RC takes the stand. JMV
