PHOENIX (CBS5) - CBS 5 News has learned a former Phoenix police officer accused of murder has reached a plea deal.

Richard Chrisman is expected to plead guilty to manslaughter when he appears in court Wednesday morning.

I don't know what time he'll appear in court this morning (10:00 AZ time when the status conference was scheduled?), wish I could find a live stream but I sort of doubt it.

Now that the ruling on the 'historical prior conviction' has come down, it all makes sense:

Or rather, the theory makes sense, but the judge didn't see it that way and struck the notice.

At the risk of facing a scolding from the Juanettes :), I agree with the judge's ruling. I think he sums it up neatly with this logic:

The State’s argument ignores the fact that Defendant’s current posture is not the result of his conduct, but rather, the happenstance of a hung jury.

So if being found guilty on count 1 at trial would have originally meant a range of 10 to 22 years, widening that window because of a hung jury is overreaching, in my opinion.

Yes, one of the links suggested Chrisman will probably get 10 years. To be honest, I don't think it's worth the gamble of going through another trial.

And I do agree with you though, after reading the entry I understood finally what the 'historical prior conviction' was all about (I initially thought it was something that happened in RC's past), I thought it was rather tricky of JM to try that, and do agree with the judge (and you) that it shouldn't come into his sentencing picture, it didn't seem quite fair since the 'prior' was the conviction JM prosecuted him for.

But, since JM did try for that to lengthen his sentence, does it surprise you that he went with the plea deal where the sentences will run concurrently and RC potentially serves less time? Or will he be given the longer sentence of the agg. assault and the 7-10 years will run concurrently? I am confused on that (and hope I didn't confuse you with a badly worded question).

Hopefully now a plea has been reached here and no retrial.....Jodi had hurry up and be sentenced.

Hi, geevee. I'm a little surprised Juan made the deal, because from what I saw during the trial, JM really wanted Chrisman to go down hard. However, and this is speculation on my part, I suspect Juan was asked to make a deal by someone above him. My thinking is, putting a cop away for second degree murder is always a hard sell. To go through another trial - with pretty good odds of ending up where you originally started, wasn't the best course of action.

Offer Chrisman a deal, make him do time for count 1 and avoid another hung jury, because really, then what? Threaten to try him a third time? Offer him a deal at that point? In my opinion, the reason the deal was made is close to the scenario I described, because as I mentioned, Juan really wanted this guy, and if the decision was solely up to him, there would have been a second trial.


As far as sentencing goes....hooboy! I have a bad track record, lol, but please, don't tell anyone else. The folks from the link you provided yesterday seem to think a 10 year sentence is in order. I'll leave that up to the experts.

I hadn't considered JM being asked to make a deal but that makes good sense, given the chance of another hung jury (not to mention the cost of yet another trial when they have to retry Arias in short order and more taxpayer expense occurring there). I presume that as well as public opinion/politics plays some part in these decisions as well.

And yeah, I thought JM would have tried RC until the cows came home to get the conviction he thought RC deserved, that just seems to be how JM is built.

You secret is safe with us. lol Thanks for your thoughtful reply, I'm rather new to all the judicial inner workings, I spent years in tax and accounting but the most we had to defend were tax returns to IRS. :blushing:
