Thanks geevee, on one of the news sites just now it said some "Adult Probation" group is making the report and that's who Judge said Chrisman can talk to or choose not to talk to.

I'm still a little confused about the whole "aggravating factor" hearing. On ABC15, Maryellen said in the newscast that the jury found that an aggravating circumstance was proven, and that makes the possibility of the length of his sentence almost doubling. Or something like that? So I guess what it does is allows the judge to sentence him to a longer time period if the judge so chooses.

It will be very interesting whether DA chooses to go for re-trial or not.

JM may have asked for the Brady hearing to kinda control the judge and also make a record for appeal if the judge goes light on sentencing. Smart move. I got this info from a defense attorney relative. I'm not this smart in real life LOL.

I just watched it on YT, he said "I will set time for entering judgement and sentencing for Oct. 18th, counsel and I have talked, the purpose of that is to get the pre-sentence report, it's not anticipated there will be a sentencing (think he misspoke the word 'sentencing' then) witness hearing that day and we will schedule it on that day at 8:30..." then tells RC under the law there's still a range of sentencing possibilities and that RC wouldn't be being uncooperative if under advice of cousel he doesn't speak to them but they will contact him. Then he excused the jurors and adjourned.

I think a pre-sentence report is usual, I don't know if it's usual for an attny to not have his client talk to them but I really have no clue about that area of sentencing.

I was wondering the same thing. Elvira and/or other family members would have the right to make victim impact statements right? But she spoke on the stand so I don't know. Maybe RC will make a statement and apologize and beg for leniency. Throwing himself on the mercy of the court as if he hasn't received enough already . Now it makes sense! lol If the adult probabtion people go over his whole record, and see the crack pipe hiding, alleged meth user angry cop (and who knows what else that wasn't made public), I can see why he might not want to talk to these people.

I am expecting him to throw himself on the mercy of the court, and his wife and whomever else he can get to sob to the judge, hopefully JM's Bradey hearing has prevented the judge from being able to give him the minimum, and his past history should only lengthen his sentence.

I'm not a hard-hearted person, I know this is probably the scariest time of his life, I do believe his tears (and those of his wife), regaining anything considered a normal life is going to be a long and monumental undertaking for him that he won't even be able to think about for years to come.

But had he owned up to what he did in the beginning and not put Daniel's family through this hell after he took the life of their son, I think the court (and maybe even JM) would have had a good deal more empathy for him. But he forced this trial with his stubbornness, and with folks like PLEA cheering him on, thought he could skate.

I'm really glad this jury didn't allow that, and I am very thankful they had the courage to convict a cop, even if wasn't for murder.

I don't know if SV feels any vindication, but I surely hope so. I'd like a cop like him patrolling my neck of the woods.

I agree Jewels, the PPD was well aware of the kind of cop he was, having anything like a Brady List where a cop can be a liar in the commission of his job and still keep that job is simply amazing to me - why is the community putting up with such an untenable system?

They have the opportunity now to tell them emphatically "We're not taking this kind of behavior any longer, get rid of the Brady List and all cops on it, and police your own cops before they become a threat to the society they are sworn to protect." I hope they will take advantage of this moment to get vocal and bring some changes to the PD.

Again, thank you (and others efforts) for the updates. As for Juan Martinez, I respect him more after this case than I did during the Arias trial. This one was much more difficult. I won't go as far as saying any other prosecutor would have failed to get at least one conviction, but Martinez did a great job! Worthy of Jack McCoy's approval... :justice:

Mehrens woulda went right through any other prosecutor. He and that other attorney who kept raising his eyebrows (IMO in skepticism) when Elvira was talking and crying on the stand.

I think Juan probably knew this would be a tough case from the beginning, and he put his all into it.

Hopefully we'll get some jurors thoughts soon, y'all...should be real interesting. Let's hope! ttyl folks....I'll prob. be checking on here for a while in case we get any more news as far as juror interviews, re-trial, etc.. Then don't forget we have hearing on Oct. 18!!

Yes aa I noticed that also, he couldn't even look towards the juror's as they were polled. I guess he was in denial! lol

After spending the last 7 weeks here with everyone, I will miss you all also. I will also be checking in and looking for any news worthy updates.
