C'mon JR - make good on your word and just plead guilty. I could live with LWOP, especially if defense plans to call Bella's sister for testimony. I haven't heard that it will but it's always a possibility. :no:

if you don't want overly emotional testimony, don't kill an eight year old!!!!!!! :furious:

So JR will also make zero sounds, facial expressions, zero head nodding/shaking, his chair will be the exact height as those of his attorneys, and, hey, so he doesn't 'influence' the jury by his appearance, he will dress and look exactly like he did the day he murdered Isabella? Deal! :notgood:

In a third motion filed Wednesday, the defense team is seeking to prohibit uniformed police officers from the courtroom during the trial. They are requesting, as well, that any armed security officers be unobtrusively placed so that the jury cannot see their badges or weapons.

Having a large presence of armed and uniformed police officers during the trial could taint the jury, Gavin and Gilleo argued, and could violate Rector’s right to a fair trial.

What rubbish. All courtrooms I've seen have had uniformed, obviously weaponed security. So all juries up until now have been tainted by seeing armed security?

Not seeing uniformed police, security, badges, and weapons in a murder trial court room would make me, as a witness, a juror, or as a member of the trial spectators, very afraid for my safety. If things went sideways in the courtroom (such as it did in Brian Nichols' case), with no obviously dressed/badged/armed security, one would just hope that maybe the dude in the back row in the argyle sweater, or that lady in the salmon pantsuit, might have a service weapon on him/her to protect the rest of us (and/or the perp should a violent vigilante pop in)?

What next? The judge can't wear a robe and sit at the tall bench looking down at everyone because it looks too...."judgey" and might taint to jury and or make JR feel bad about himself?

I can't even.... :gaah:

Ha! The State's response to the defense request for no uniform, badges, visible weapons on officers is awesome. The state rightfully (IMO) calls the request 'silly'. The rest of the response provided by the state pretty much outlines the points I mentioned above.

Judge Billy Sipe didn't buy the defendant's excuse for selling methamphetamine, which he claims occurred while he struggled to come to terms with depression he suffered after the murder.

In determining an appropriate sentence, Sipe told Folster he started at the presumptive prison term of 15 years and nine months. From there, said the judge, he would go up or down based on a number of issues, including Folster's criminal history.

That history is lengthy. Sipe noted Folster has spent most of his life in prison since he turned 18 a decade ago and that he also has a serious juvenile record.

Bella’s mother, Tania Grogan, 29, was arrested two months after the girl’s death on drug charges. She is jailed and is more than eight months pregnant. Her attorney, Brad Rideout, said Grogan will be transported from the Mohave County jail to a local hospital when she’s ready to give birth.

Grogan will go back to jail before entering a drug sale plea agreement in June, Rideout said. He said the deal with the state calls for imposition of a five-year prison term.

Saddens me that the defendant had to use Bella's death in why he did this. Nope you weren't depressed and distraught. Your a convicted drug dealer. Please leave Bella out of the reasons why you broke the law.

Tania should be getting at least 20 years too. Glad that awful person Ralphie is away for a long time but really 5 flipping years for the worlds worst mother????

Next up is Freddie - her hearing is this Friday (the 8th). Then comes Tania's turn on June 4.

Grogan, 29, is charged with conspiracy to sell dangerous drugs, sale of dangerous drugs and possession of drug paraphernalia. Grogan is expected to agree to a plea offer at her next hearing June 4.

Folster’s mother, Nicholson, 59, is charged with conspiracy to sell dangerous drugs and possession of drug paraphernalia. Her next hearing is set for Friday.

:tos: But......... how can a trial about murdering a baby have no EMOTIONAL testimony ? How? I know defense attorneys have a job to do but you can't erase emotions from a case like this and honestly it's sickening to even try. Sorry your client gave you very little to work with but people are allowed to be upset that a baby has died !!!!

Ooh, a little drama in the courtroom last week:

Defense attorney Gerald Gavin essentially accused prosecutor Greg McPhillips of "orchestrating" the public release of jailhouse telephone conversations between Justin James Rector and his father in which Rector strongly implied he was guilty of killing Bella Grogan-Cannella after being under the influence of methamphetamine for days.
...
[Gavin] asked Judge Lee Jantzen to require McPhillips to warn him "if the state releases information on phone calls allegedly made by my client. This is a clear attempt by the state to shortcut the proceedings," said Gavin.

McPhillips hotly advised the press made the Freedom of Information Request that led to the release of the taped conversations in March and it involved the Bullhead City Police Department, not his office.

The third request Jantzen denied was a request for defense attorneys and their investigator to visit the crime scene to view, photograph and otherwise document the location.

The attorneys, however, failed to mention whether the property was public or private - the girl's family rented one side of a duplex. Jantzen wrote that he found the request "general and speculative" and ruled the attorneys failed to show how having access to the crime scene would produce "material and relevant evidence not otherwise provided to him."

KINGMAN - Of the more than 15 pleadings filed since March by attorneys representing a man facing the death penalty, Judge Lee Jantzen on Wednesday denied six - including one that asked the judge "to thoughtfully reflect and re-examine any beliefs or feelings" that would compel him step aside due to built-in biases.
