Trial of boyfriend in Kiera Bergman murder case moved to Pinal County

Jan. 28, 2022

The murder case of 19-year-old Kiera Bergman, whose body was found west of Phoenix after being missing for nearly one month in 2018, has been moved to Pinal County, officials said.

Arizona's Family was the first to report the news on Thursday, citing Bergman's family members who said "complications" with a former attorney prevented the Maricopa County Attorney's Office from taking the case to trial.

A judge dismissed the case without prejudice in early 2020, saying that prosecutors mishandled Silent Witness records. Dismissing a case without prejudice allows prosecutors to refile charges if they decide to do so.

The Maricopa County Attorney's Office confirmed to The Republic on Friday morning that the case was handed over to Pinal County, but said it could not comment further on pending prosecution.

The Pinal County Attorney's Office said it agreed to take on the case, but referred The Republic to Maricopa County for further details as to why it was moved.

Pinal County has requested a continuance until late spring or early summer "due to the complexity of the case" and is awaiting the judge's ruling, Attorney's Office spokesperson Mike Pelton said.

Clark's trial is currently scheduled for Feb. 22, according to court records.

Hello Everyone! I apologize that we have not given an update in a while but truthfully there hasn’t been much happening with the case until recently. We were informed about a week ago that because of complications with a former attorney on Kiera’s case the Maricopa county attorney office can no longer take Kiera’s case to trial. With that being said the case in it’s entirety is being transferred to another attorneys office. It is still unclear who will take over the case and when the trial will finally begin. We still continue to ask for prayers as this has been an ongoing process going on 4 years. In truth the system has done nothing but fail Kiera and many other young women who have gone through this same thing! We understand delays happen and we by no means have lost hope but in this time we need a miracle in order for a smooth and just trial. Thank you everyone for the continued support as we still search for #JUSTICE4KIERA!

I don't understand either, other than there must have been some "issue" with an attorney working the case. I feel for Kiera's family, this has been a nightmare for them. If we read between the lines, it seems this case was mishandled from the get-go.

The trial of an Arizona man accused of killing his teenage girlfriend has moved counties — and, according to the district attorney’s office, it was at their request.

Clark was officially charged with Bergman’s murder on Sept. 11, 2018, according to Phoenix CBS affiliate KPHO, but the court dismissed the case without prejudice after the prosecutors failed to disclose certain legally-required information during discovery.

They were allowed to re-file charges against Clark if they could provide the court with sufficient evidence... which they did several months later, according to KPHO.

But with the second trial against Clark set to begin in less than a month, prosecutors in Maricopa County apparently turned the case over the to colleagues in Pinal County — who have asked for a delay, according to the station.

Maricopa County prosecutors declined to tell KPHO what complications in their office necessitated moving the case to another county.

Found the following information under “Minute Entries”:

So it appears now the Final Trial Management Conference has been rescheduled for tomorrow at 9:50 AM (if I am reading the document correctly).

It also appears to address further dates, but I don’t want to put any wrong info out there, so I’m just going to leave the “raw” info. here without any sort of summary (sorry ). Hope this helps in some way!

Thanks for that minute entry update @inmyhumbleopinion - I also looked in the court site. It looks like the 3/8 hearing was moved to tomorrow, 3/9. And the trial was supposed to start on 3/22/22 - was moved to 3/24/22 per the notes in your post. So - I'm thinking - jury selection on 3/24 & trial begins on 3/29/22. Nothing was mention about the pretrial hearing on 3/14/22 - so I am going to "assume" that is still on.
