The lawyer for an Iraqi immigrant accused of slaying his daughter in an "honor killing" is asking a judge to take special precautions to ensure the Maricopa County Attorney's Office doesn't wrongly seek the death penalty against his client because he is a Muslim.

In a motion filed last week in Maricopa County Superior Court, attorney Billie Little requests that the court force the County Attorney's Office to make public the process it will use to determine whether to seek the death penalty for his client.

Faleh Hassan Almaleki, 48, of Glendale, has been charged with first-degree murder in the death of his 20-year-old daughter, Noor Almaleki.

The elder Almaleki is accused of using his Jeep to run over his daughter and another woman in a Peoria parking lot on Oct. 20. His daughter later died of her injuries.

During a news conference last month, County Attorney Andrew Thomas said his office was still determining whether to seek the death penalty for Almaleki. He called the case "tragic," saying the county will prosecute Almaleki to the full extent.

The death penalty??

This also has nothing to do with Islam. Christianity is the same. The problem is Christian fundamentalists do not (yet) control America like Islamic fundamentalists control much of the ME. Most Muslims do not treat women this way just as most Christians do not, but if they are fundamentalist and take their religious literature literaly they do.

PHOENIX - A homicide case that drew attention to so-called honor killings moves into the trial phase this month for an Iraqi immigrant accused of killing his daughter because he believed she was too Westernized.

Faleh Hassan Almaleki, 50, faces life in prison if convicted. In October 2009, he slammed his Jeep into Noor Almaleki, 20, prosecutors said.

Faleh Almaleki is charged with first-degree murder, attempted first-degree murder, aggravated assault and leaving the scene of a serious injury accident.

Some of his court dates were postponed because he was on suicide watch for a while and his lawyers said he didn't understand the judicial process. His trial is set to begin Jan. 18.

In October 2009, he slammed his Jeep into his daughter, Noor Almaleki, 20, prosecutors said.

The woman, who longed to live a normal American life, was in a coma for two weeks before succumbing to her injuries - in a case that caused outrage from people nationwide.

Glendale man to stand trial in daughter's 2009 death

An Iraqi immigrant accused of killing his daughter because he believed she was too Westernized will go to trial in Phoenix after he failed to reach a plea deal with prosecutors.

Prosecutors and attorneys for Faleh Hassan Almaleki, of Glendale, had been in discussions about a plea deal for weeks ahead of a scheduled Jan. 18 trial date. Barring a last-minute deal that appears unlikely, Maricopa County Superior Court Judge Roland Steinle said at a hearing Tuesday that he would call two large groups of potential jurors next week.

(CNN) -- Sentencing testimony begins Wednesday in the case of an Iraqi man who was convicted of running over his 20-year-old daughter because she allegedly had become "too Westernized."

A Maricopa County, Arizona, jury convicted Faleh Hassan Almaleki, 50, on Tuesday of second-degree murder in the 2009 death of Noor Faleh Almaleki.

It also found him guilty of aggravated assault, for causing serious injuries to Amal Edan Khalaf, the mother of Noor's fiance, and two counts of leaving the scene.
