Giffords had been in intensive care at Memorial Hermann Texas Medical Center Hospital. Doctors on Tuesday night said her condition had been upgraded from serious to good and that she was ready to move to TIRR Memorial Hermann, where her rehabilitation will begin.

The movement from Tucson to Phoenix in the first place was done rather abruptly, actually. The judge is putting a halt to the unexplained back and forth and putting some order back into the proceedings, as I see it. He will probably move Loughner back to Tucson since neither side objects, but only after allowing the proper motions to be filed and a discussion to be had on the status of the case (on March 9). Also keep in mind that transporting the inmate back and forth is a complicated venture, that he probably doesn't want to see happening more than once or twice.

As for whether he's a good judge or not, he is a highly experienced federal judge with a strong background in death penalty cases, and high profile cases too. I've heard only good things about him.

Since Loughner has waived his right to a jury trial, there is no reason not to move it back to Tucson. Just my opinion, it is the correct thing to do. No change of venue as only the judge decides his fate, the large majority of witnesses are located in Tucson, as are family members of the victims. Make it easier and less cost intensive for them to testify as they will be required to do. If I am not mistaken, there are two federal facilities for incarceration near Tucson - is that correct if you know ?

My guess (total speculation) is that he's housed right now at FCI Phoenix, which is about 25 miles northwest of downtown Phoenix. The Tucson area has at least 3 federal facilities that could house him.

But, I don't believe Loughner has waived his right to a jury trial. That wouldn't be a wise move on his lawyer's part, since this judge doesn't exactly have a reputation for being a softie.

Just posting on Laughner here again, so confusing. I have been looking at Erad3 posts and IMO he is also Christ! on the ATS postings, however, Erad3 only goes back one year. In 2007 he asked Gifford "how do you know words have any meaning?" I have to assume he has had access to computers, and sites like that have multiple members.

I am posting because i am wondering if anyone here remembers any wild threads between 2007 and 2009? Members who have been banned for offensive comments would most likely be his route off Websleuths, as he does name call on his Erad3 posts. THanks

Catheter Draining Fluids from Injured Congresswoman's Brain Removed before her Transfer to Rehabilitation Facility

HOUSTON - Doctors at a Houston hospital said a catheter draining fluids from Rep. Gabrielle Giffords' brain was removed ahead of her transfer to a rehabilitation facility.

The hospital statement was more good news for the congresswoman who was seriously injured in a Jan. 8 shooting in Tucson, Ariz. Giffords was transferred early Wednesday from the hospital's intensive care unit to the rehabilitation center.

Doctors said Giffords has been making good progress in her recovery since arriving in Houston on Friday.

Now doctors said Giffords will begin a full rehabilitation program.

Helicopters buzzed overhead and police stopped traffic and blocked the road as an ambulance took Giffords and her husband, astronaut Mark Kelly, a short way to TIRR, which stands for The Institute for Rehabilitation and Research.

Video from a news helicopter showed a gurney wheeled into the building.

On Friday, Giffords left the Tucson medical center where she had been recovering since being shot in the head at a public even Jan. 8. Doctors and her family originally planned to move her straight to the rehab center, but a fluid buildup in her brain raised new health concerns and Giffords went instead to Memorial Hermann Texas Medical Center Hospital where she has been in intensive care.

Mr. Loughner, 22, pleaded not guilty on Monday to three counts of attempted murder in connection with the shooting, which left six people dead and 13 injured. Representative Gabrielle Giffords, Democrat of Arizona, was shot in the head but survived. Additional charges, including murder, are expected.
