Baez Files 8 Motions In Case

He knows dam**ed well that the prosecution has an ethical duty to provide him with exculpatory evidence.

But seeing as he has alientaed all of LE, he might as well diss the entire District Atty's office as well.

This guy will never be able to bargain on behalf of a criminal client ever ever again.

He seems to have forgotten he is going to be "Cooking in that Kitchen Again.".....as they say.

I agree - BUT Baez will get the evidence WHEN Casey is charged with that crime - what he's trying to do is tie in all the homicide evidence into the neglect charge - then the state will have to one of two things - ONLY charge her with neglect OR charge her with homicide

nah some of our legal beagals here have stated that they can allready do this if they want and they can charge her with the neglect and later still charge her with murder.

They just cannot charge someone with something like manslaughter then charge with murder. You can't change the level of the specific initial crime, but you can charge with an additional crime. Neglect and murder are two different crimes and can be tried as two seperate cases. Plus you can look at it as perhaps she neglected her first, murdered her later. Two seperate incidents a well.

I am now convinced Baez is getting legal advice from us.

It was posted repeatedly yesterday that his motions were too broad and not limited to materials within the custody or control of the State. I had a real problem with that.;)

Today he has changed his language to reflect the correction.

Considering the stuff was spit out of a computer, he would have to have it reformatted to reflect the change.

I was starting to think the exact thing! Maybe we need to place the Forum in LockDown!
 
My question is "What's in this for Baez?" The only answer that I can come up with is that people on the jury are bound to ask themselves "Why did this mother never spend one day searching for her daughter?" That alone is very damning IMHO.
I suppose he is going to say "She wanted to but was afraid" I don't think it's going to fly. Maybe he should have thought about this in July.
What parent does anyone know who would let ANYTHING keep them from looking for their child. At the very least she could have told LE or the FBI where to look for the child.

Plus she never spent a day searching for her because she slept all day maybe since she spent all her nights looking for her 2 year old daughter in bars.
 
I think the Biaz is going to have to bring in some experienced help to survive even the first week of this case.

or Cindy will be running him into the ground the first time the reporters ask her.
 
I am not from Florida and this case gets very little media coverage here in So. Calif, will the court hearing tomorrow be televised?

I am not sure where to post this, but I was wondering something. Is there any legal requirement that an attorney must have some sort of additional education/training/experience to handle certain types of cases? I would not think that just anyone could adequately defend certain types of cases, especially if the stakes are so high, like if the death penalty is on the table.
I understand that a person can act as their own lawyer, and they can choose their own lawyer. But, if that attorney does not have a special skill set, or does not bring in another attorney who has that skill, how could there not be a claim of inadequate counsel?
I do not have a legal background, so I can only relate to my own experience. I am a nurse, and have worked Emergency/Trauma/ICU/Pulmonary Critical Care for more than 20 years. However, I could not safely or adequately deliver a baby or give chemotherapy,as other nurses do, because I do not have that education or experience. See what I am trying to ask?
Just on the surface, JB seems not to be the brightest bulb in the chandelier, so is he mandated or ethically required to get help?

While I know there is CLE (continuing legal education) classes specifically for certain areas of law, I believe if you pass the State Bar, you can practice law. I don't think there are specific State Bar exams (personal injury, criminal, etc..), but I could be wrong.

What kind of exculpatory evidence does he think exists that he hasn't already seen? The only thing I saw were all those interview comments by her former friends, expressing shock that someone who seemed to be such a loving mother was in fact a liar, a thief, and the worst mom in the world.

Good luck with that, Jose. If you haven't been able to come up with anything after weeks of sitting with your client for hours on a daily basis, what makes you think anyone else found anything that would help her at trial?

If you were an undercover agent or a confidential informant, would you feel safe with this information in Baez’s possession?

"The names and addresses of any persons who have acted as undercover agents or informants during the course of the investigation in this case, regardless of whether such agents or informants police officers, indicted defendants or unindicted co-conspirators."

Hope I did that right - anyway, he says she wants to revisit certain places, etc with him! Well, I think she can't remember what these places looks like, even though she claims to have been to them (as in Zanny's place) over and over. she need to go look at them again so when she is asked to describe them she can. I think they just want to refresh her memories as to what the places that she lied about look like. Nothing worse than not being able to describe a place in court, under oath, that you have been claiming you have been going to for so long!
