Baez Files 8 Motions In Case

sorry, I cant' remember who else on the thread said this, but I think this could be a move to force LE to file murder charges before they have the case ready. as it stands right now, since she has not yet been charged with murder, he's trying to make a case that there's no reason to prevent her from traveling or restrict her movements because, as it currently stands, she is just the mother of a missing child. he could also use it in the future to say that "she tried to help the investigation, but was denied by LE", etc. it's a risky move on his part but that's the only reason strategy-wise that I can think of that he would file this. the motion to travel has got to be a strategy move in some way, IMO, not because he actually thinks a judge will grant it.
You might very well be right.
JB might be pushing the envelope, wanting LE to make a charge or shut. I think they have all the evidence they need, except Caylee - might backfire on JB and KC

K - here's what I've found: NO published federal FL cases involving a Jose A. Baez as counsel, BUT there is a Jose A. Baez and a Jose Anibal Baez listed in several published cases from NY... so do we know yet if Casey's counsel is also licensed in NY and/or if his middle name is Anibal? Interesting if he were, since WAAAY back when she said folks needed to be also searching NY for Caylee...

Lol, I saw those early on, and discounted from proximity, but I do know that he was there on biz a few weeks ago. I thought the cases were appellate and Fed, I must have just glossed over then.
Although, I assumed he was in town on the 20/20 deal.

Hi all new to post, but I thought that is why we have PI'S for to go look for information, ect. :confused: I think maybe they should find one to work on the case to talk to KA instead of letting her go look, she will be long gone if they do.:furious: just my thoughts.

Proving the child is dead has nothing to do with child neglect charges. She dropped her child off and didnt report her for 31 days thats child neglect makes no difference if the child is deceased or alive. Casey already admitted she lied and sent them on a wild goose chase, has nothing to do with forensic evidence. If she had reported her missing immediately then there would be no child neglect charges filed. Until they charge her and say Casey killed this child they are not entitled to any of that evidence.

I disagree. I think evidence that the child in question in a child neglect case might actually be DEAD is very much admissible. if the evidence shows she IS dead, it means CA lied to LE and the making false statements/obstruction charges hold up. if the evidence in the trunk shows that she isn't dead, it backs up Casey's story more. notice that in these motions Baez makes no mention of pending homicide or murder charges.

yes, that is all Baez is entitled to or deserves, in your opinion. the legal system, however, does not run on the basis of public opinion. complain about it all you want, but we don't live in Indonesia, and, guilty or not, we all have the right to a fair trial.

She admitted making false statements to the police, she did not report the child missing for 31 days. Doesnt make any difference if they want to argue the story about the Nanny is true. She gave wrong address, she gave wrong employement information, she gave names of people that dont exist and on it goes thus false statements to police. She did not report child missing for 31 days, therefore neglect of a child makes no difference if the nanny story is true or not.

she has, however, been charged with making false statements to police. if they can show that the body farm evidence is inconclusive or wrong, then that leaves the door open for them to argue that Casey's story about the nanny is true. it's all strategy anyway - he might be pitching to get all the evidence just to see what evidence he can actually get out of them, not because he thinks they'll actually give him everything. remember, this is just what's in his client's best interest to do.

Unfortunately he was picked off of a wall of business cards. I think he is way over his head in this. It proved it when he filed the first motion he flubbed on royally. So hopefully he filed these 8 right. :rolleyes:

I just love how the article makes it seem like all of this is just so NORMAL. Oh, yes, maybe Baez will just have to fly around the country with her. OMG! If I was WESH I would have tried to get a comment from the other side. IF LE refused, they should have done a "man on the street" segment and seen what the general public thinks about JB's motions. Though, slightly OT, but not really 'cause it's in the article that's posted, how did the A family expect to have supporters at a vigil if they didn't let people know what church? Something tells me there is a whole heck of a lot going on online in that house.

Supposedly, they do have PIs, but no one's heard anything about what they've done or have been doing. Doesn't matter, 'cause JB can always claim Casey is smarter than anyone trained to locate missing children...like LE.

As early as this weekend, the head of Texas Equusearch said he'd like to resume his group's recovery efforts in and around Orlando. He said he would love to have Anthony's help.

"If she said she was willing to take us to areas of interest, I'd be on the next plane out," Tim Miller said.

A spokesman at the Orange County jail declined an on-camera interview, but said this kind of request is highly unusual and would likely require Anthony's attorney to be with her at all times. For his part, Baez has argued since a July interview that confining Anthony stalled the search for Caylee.

Baez turned down an interview request but his spokesman said Anthony is not interested in helping Texas Equusearch as that would be equivalent to admitting her daughter is dead. The spokesman said she is only interested in pursuing live sightings.

don't believe he can get everythng LE has - only what they are using in current charges - what they have that they might be holding for more serious charge, KC not charged yet - JB doesn't get that eveidence
Yeah, but he keeps making a nuisance out of himself for asking.

actually, he's not making an 🤬🤬🤬 of himself - whatever you want to say about his client, his role is to serve her best interest, and it is in her best interest to get the evidence against his client he can't effectively represent her otherwise. any good attorney would file these same motions. not to play devil's advocate here but these are pretty standard motions (with the exception of the motion to travel) in any case. a good attorney is not going to sit there like a lame duck and wait for his client to be charged.
totally agree. seems like SOP, for the most part, to me.

That is perplexing considering Cindy has openly admitted there are currently 3 private Investigators looking for a "live" caylee and have been for some time/ Add to that LE and the entire TES team, I would think they would want everyone and their brother looking, if the are to find an alive Caylee, that would be the obvious upside. Obviously what she is afraid of is what they will find.

So Casey wants to travel to find her daughter. Now really, why would a judge allow that when she hasn't been truthfully forthcoming with any helpful information? She should be mighty grateful I'm not the judge in this case. Her little butt would have never been released from jail after all the lying stunts she pulled. :gavel:

That could add up to some pretty serious neglect.

He also requested a lot of things which have nothing to do with his clients charges. Maybe he could ask Judge S for all the sealed documents on the Kennedy assasination as well. And if Judge S can get jurisdiction in Aruba.....

Our legal system is a "One step at a time" system. Mr. Baez seems to have jumped ahead a few steps.

Baez should move to Hollywood and become a sitcom writer! He may have to after he is done with representing Casey!

I really think an inditement is coming soon. The D. A., IMO, is not going to try Casey on Child Neglect if it would preclude being able to charge her with murder at a later date. Has it been made clear as to whether or not this would be true? I have heard both said.

I think MN would help his own cause by sitting down for a cup of coffee with JB a few times a week for a father/son chat.

I reckon he may take him to the woodshed over the phone occasionally
