This guy yelling watch out and ringing is bell is always startling. If I approach a pedestrian on the trail, I always give a shout and INVARIABLY they move into my path on instinct. I always anticipate that and will come to a complete stop if necessary.
This guy is a ding dong and there is no way he will win this case IMO!
I agree JBeanya; when I am approaching someone from behind, I always tell them on which side I am approaching them, and passing them on, which is almost always "On your left" but in the same breath, I am always prepared for whatever move they choose to make, or whatever side they care to move to. It's my responsibility to avoid them.

Maybe this idiot doctor is trying to cover up some reason that he went around the block again and up behind an 11 year old girl in the first place.

This is the stupidest thing I have ever heard. What kind of person would do this to a child? I hope he is made into an international laughing stock, which he sorely deserves and I hope his patients find new doctors. No way would I want someone like this disgusting creep helping me have a child - or any other medical matter. And that lawyer - the other forum mentioned the lawyer was a former two termed mayor. I can't believe any judge let this get this far, but, I hope that jury is out 2 minutes and comes back with a verdict against this bozo.

Exactly Buzz. I find no matter what I yell, they always lean left into the trail before going right.

Its still before 9 am and I am working on my first cup of coffee so I must be missing something.

I hope the jury laughs as they tell him to blow it... I think the judge should admonish the Dr's attorney for even filing such a frivolous case and I also think the judge should make the DR pay for all the Lawyer fees and court costs as well as reemburse the parents for any time they missed at work and then be made to make a public apology to this little 11 YO WHO HE HIT with his bike!

I'm missing it, too. This doesn't make any sense.

I hope he gets one of those no-nonsense judges that will not only NOT award him anything, but will also tell him off from the stand. I'd like to hear that....

Closing arguments are scheduled for Monday.

Let's hope that the court at least awards the girl, and her family, all costs, including attorney's fees.

Like so many others, I am hoping this nonsense suit, leaves an indelible impression on his business

Did the girl dart out from between two cars? If so, it is a tragic accident. I don't think that you can hold a minor child liable.

If the girl were in the road and the guy saw her, he should have adjusted his speed and either come to a stop or gone around her.

One would think nanandjim. That's just it, he didn't 'think' beyond thinking that he was doctor almighty and all should yield to him. :loser:

Uh, I agree with you guys are much as you do that this is dumb...but you guys certainly have too much free time if you look up his address and telephone number, let alone call or e-mail him. Give me a break. :waitasec:

No she did not pull out between 2 cars.
He drove aroud the block and passed her once ... then did the second pass while he yelled and belled...
Can we all say A**hole??

If he saw the girl first, called out to her and had time to ring his bell - certainly he had more time to react to avoid the collision than she did. I'd lay my bike down before striking a child... and was swerving not an option?

Did the Dr. fall on the girl's property and that is why this lawsuit even went anywhere?
