This was parked outside at a condo in Toronto. Not inside parking with a fab needed to get in. It wasn't locked.

There was a fifth wheel hitch used to tow a trailer on Palmili's truck too.

Sachak zeroing in on the mumbling of the caller's name. “It wasn’t something that was so suspicious because you made arrangements to see him,” he says to Palmili.

Adam Carter
Feb 4 2016 10:31 AM
Palmili says he asked the caller twice to give his name, but never asked him to spell it.

#Millard lawyer confirms with Palmilli his police statement mentioned nothing about caller lowering tone of voice, mumbling when asked name.

Mark Carcasole ‏@MarkCarcGlobal 2m2 minutes ago

Moody objects, says there is a second statement to police about why Palmili didn't understand the caller's name. Justice Goodman says questioning is okay, as this is about this specific statement.

Adam Carter
Feb 4 2016 10:37 AM
But he did say in the statement he couldn't understand him.

Adam Carter
Feb 4 2016 10:36 AM
Palmili says that is correct.

Adam Carter
Feb 4 2016 10:36 AM
In the statement Palmili gave police, it doesn't say anything about the tone of voice, or mumbling Sachak says. “But you indicated those three things to the members of this jury today.”

#Millard lawyer points out Palmilli says in statement caller has "deep, masculine voice" throughout call.

Mark Carcasole ‏@MarkCarcGlobal 2m2 minutes ago
"I asked his name...I asked him twice because I couldn't understand him...Still can't understand," reads #Millard lawyer from statement.

Mark Carcasole ‏@MarkCarcGlobal 2m2 minutes ago

“This person never said in clear loud english ‘My name is Dellen,’ did he?” Dungey asks, gesturing to Millard. Palmili says no. Dungey now done. Crown is back up now, asking questions about the security of the condo parking lot.

Adam Carter
Feb 4 2016 10:43 AM
Dungey zeroing in on the mumbled name. “Only when it comes to his name -- only his name -- all of a sudden he lowers his voice and he mumbles it.” Dungey says. "Correct," Pamili says.

Has anybody figured out what the basis for Millard's not guilty plea is? His lawyer doesn't seem to be denying anything or even be trying to cast any doubt on what has been presented. Are these guys just hoping there will be a plea deal of some sort at some point? I just don't get it.

Crown asking if this first statement is the first time Palmili had spoken to police and if he was a little nervous. He says yes. Palmili now done. 5 minute recess up now.

There are two cameras pointing at the lot, Palmili says he thinks, but he's not sure about how secure it is.

So far we're just talking about a guy making arrangements to buy a truck with various sellers. DM is not disputing that. He will pass off the burner phone and fake name as "for his privacy and protection", even though he walked up to a stranger's home, from an online ad, in a rural area with no way to get out quickly. Maybe that's why he brought MS with him?...just in case he was in danger...and that's probably also why MS brought a gun right?...well according to DM's version. Anything can be twisted and likely it will be. He's an innocent dupe dontcha know? ;)

This will be a he said/he said case. Hopefully his antics in the courtroom for the first few days before he was reigned in have shown the jury just what kind of guy they're dealing with here.

Maybe not saying he's totally innocent of something just saying it wasn't first-degree murder, which is the charge against him.

(not my opinion - I think he's 100% guilty)

I agree they are trying to say he didn't intend to kill someone it was the a surprise to him and the other parties idea

The problem I have with that theory is that at some point after the murder Smich or Millard left the car to drive the Yukon. At this point if his intentions were not to kill why did he not just take off and talk to the police. Instead he stripped a car, burnt a body, intended on taking the truck to a body shop, had the keys in his car, purchased a burner phone, owns an animal incenarator on a farm with no animals, and the list continues. If I didn't intend to kill someone I wouldn't be the one using my properties to try cover it up.

Not to mention parking a truck with a murdered man's blood still inside it in your own mother's driveway.
