Here's my usual note of sympathy for the jury. I did one day in a potential jury pool, and that was brutal enough.

Jones is the 67th witness called so far by the Crown at the Tim #Bosma murder trial. Another 39 to go. We're on Week 6.

Wow, it does not seem like there has been 67 people on the stand already....

That barely seems possible given we are on day 20. That would mean over 3 witnesses per day, which is a lot given all the legal arguments that have taken so much of each days total time.

Several of us have had a 'huh?' reaction to that number. I don't know.

Hope the Jury member will be ok. What happens if a Jury member calls in sick? are they allowed to? I know there have been so many bad virus going around this month. How can you expect all members of the Jury present 100% of the trial?

ok so here is the glass...they said it was rolled down inside the door and they had to take the door panel off to get it out..they laid it down on a piece of kraft paper

Feb 16 2016 11:04 AMCourt now seeing a picture of the window out of the truck, laid on the ground. The top is shattered, and there are spiderwebs of cracks on the bottom part of the window.

no blood found on the window? did I miss that? You would think if he was shot in the head or the neck there would be spatter or matter on the window..and lots of it..especially of the bullet broke the window.

Correction - Neither of the accused was ID'd by SB just a "short guy" and a "taller guy". Igor Id'd MS for a previous test drive, no murder took place.

We have more proof of DM's involvement (web records showing he searched for these car listings, phone records, finger prints on vehicle, vehicle and remains on property). On the otherhand, we have nothing on MS except phone records that place him in the general area with DM.

So no solid evidence that puts MS in the truck at time of murder.

BUT we do have MS's girlfriend MM's testimony, who will likely give testimony for the Crown. The way the Crown stated this, it sounds like MM told LE it was DM who shot TB according to MS. Why do I think MS will take the stand in his own defence?! And of course DM won't let MS get away with giving his testimony alone...I see DM also taking the stand. MOO. :D

Also on this day, May 7, 2013, Mr. Millard told his roommate that they had stolen a truck on May 6, the day before. This roommate already knew that Mr. Millard and Mr. Smich planned to steal a truck of this kind. The Accused had told him this plan on the weekend.

Mr. Smich told his girlfriend that Mr. Millard stole the truck and that he (Mr. Smich) was there. Mr. Smich also said that the man they stole the truck from , who the Crown says was Tim Bosma, was quote “gone gone gone”.

I thought the same thing....then I remembered we had a day or two where they were going through a LOT of witnesses in short order. Remember the guy who was called about the truck but missed the call? The body shop guy who was called about painting etc. etc. They sawed through 10 or 12 on that one day. That is the only way they got to that significant of a number. Anyone have a summary of the witnesses? LOL!

An ambulance is here on the ground floor of the courthouse now.

So, a juror felt suddenly I'll in the courtroom and had to leave quickly. Done for the day and not sure what will happen tomorrow.

A few people have noted that it is very warm in the courtroom today. Usually it's chilly. Hopefully juror is ok.

I really wish we had a thread for all the pictures..it's really hard to sift through all the twitter feeds and MSM for a picture when you need it LOL

I've been struggling with the whole window thing. My instincts are telling me that it was broken after the fact, maybe when they were stripping the seats etc. from inside the vehicle. No way they would have been able to clean blood off of that window after it had been shot like that. MOO

Phone records do not place MS anywhere....they only place his phone.

I have a feeling that the glass shattered but stayed in a sheet. Safety glass does this, and if Tims truck had tinted windows, it definitely wouldn't break. I think that is why they drove off in to the countryside, to dispose of the glass. Then they came back and were videotaped along the logical route.

Or perhaps the window just shattered from the shot but didn't fall out. During washing maybe the force of the water made the glass fall out. Washing would explain why no blood found of the remaining glass IMO.

IIRC one day they went through seven witnesses. MOO.

The fact that the heat in the truck was maxed out leads me to believe that the window was gone that night. I think they notice the witness that spotted them in the field and bolted. I feel the simply didn't want to drive around with a shot out window, so they drove somewhere to knock it out.

You might be right...I can only imagine the Abbott and Costello routine that must have been happening when these two imbeciles were stripping the truck

Court will not be held if a juror is sick for a day or two. The judge may even excuse them from jury duty depending of the health issue. MOO.

I agree that at this point there is little evidence against Smich. I think that video of the two of them firing up the eliminator is going to be the piece of evidence that ties all the smaller pieces together. The video puts him with Millard immediately after the crime. His cell phone records put him with Millard all evening.

do they not have an alternate?

do they not have an alternate?

They do, but they wouldn't want to play that card so soon. A lot of trial still to come and if you loose another you have to get by with 11.

  • #220
do they not have an alternate?

Yes they do. There are 13 in total right now and they can go down to 10 for deliberations. HTH and MOO.
