Location of Brantford Bobcat in relation to Kemira Water Solutions. As I posted last night, it appears that they may have stayed in this area for at least 15-20 minutes as DM's cellphone pinged there (Paris Rd and Hardy) at 9:44pm and TB's phone powered down at 10:02pm. And according to this testimony, they should have been in this area around 9:44pm.

ETA: Okay so they passed Brantford Bobcat at 9:49pm. TB's phone was accessed at 10:01pm, powered down at 10:02pm. They were there for at least 10 minutes IMO.

I just speculated that it was a possibility. They drive to the field, DM pulls the gun and says something like "be cool, we're taking your truck. Don't move or I'll kill you. Smith gets in the other vehicle. The trucks pull away, the plan being to leave TB in the middle of nowhere without a phone. Tim contemplates the situation while Millard drives and decided to make his move when he believes Millard is distracted. The reason I theorize this is that no glass was found in the field and the witness testified that he didn't see any sort of a ruckus going on.

This could be the only possible scenario where one of them wasn't actually present, however as others have pointed out, if he's killed during a kidnapping they are both still guilty.

"Don't move or I'll kill you"...TB had a wife and daughter at home: why would he fight a man with a gun?

DM intended to kill TB with the gun, IMO, right from the start.

It is not fair to place the blame of TB's death on TB for somehow fighting or struggling with a gunman, when it seems absurd that he would do so.

The timestamp on this video is also off by 58 minutes. The correct time on the video should be 9:49 p.m., Plaxton says. He says he always allows plus or minus one minute for mistakes, so he essentially added an hour here.

He's never seen any other case where someone has done something so unspeakably foolish.

And they gave up their lives of freedom all over a truck. Greedy...&%($#%(. DM had gone down the road of murdering twice before and never got caught. He thought he was the perfect murderer, Dexter. Seems like DM had more to gain than MS IMO.

TB was murdered by a loafer that made $125,000 a year for a material thing.

Remember, when he was talking about MB, he said he was "an extension of another life".

DM is the one who allegedly shot his own father. That to me speaks volumes. When someone has the audacity to murder their own father because of greed, he was willing and eager to do it for a truck also. MS was his lost puppy who just followed him and helped him for a chunk of change. IMO DM was the shooter. Hopefully we will hear if there was any blood evidence found in the Yukon. If not, or if very minuscule amounts were found, to me that would suggest MS was not in the back seat of TB's truck when TB was shot. And we know these two aren't the brightest crayons in the box, an order of fries short of a Happy Meal, but I really don't think DM would have trusted MS with his gun, to fire it under DM's nose (if MS was outside the truck, on the driver's side) while aiming the gun at TB. But that's just ALL MOO.

Bottom line is, I hope they are both found guilty of first degree. Premeditation. MOO.

I've considered that argument, however there is a difference there. What Dellen wanted required from Walter Millard required him to be dead, there was no other option. In this case Millard did have options. Tim wife had and neighbour had already seen them. Thats not enough to call off a truck theft because frankly, the cops don't give a crap. But to commit murder when two people had just seen you? I have no doubt about the things DM would do, and I have no doubt that he had no problem shooting Tim if the circumstances called for it, but I still feel this is just a robbery gone bad.

I take offence at that, I never suggested that. What I suggest is that TB may have been in transit to an increasingly rural area, against his will at gunpoint. In a situation like that you have to make the decision as to whether you are going to let these guys drive you to a remote area and put a bullet in your head, or are you going to pick a moment and fight back. That is a long way from suggesting that he "deserved" what he got.

I don't think TB ever got the option to fight. They brought the gun to use it, because an incinerator was going to take care of all the evidence. ETA: I really doubt the perps were thinking, whoops, that was unexpected - good thing we have an incinerator. They drove directly to the farm to pick up the incinerator and to the hangar to use it, without pause. I think the incinerator was part of the plan.

The premise of switching drivers could have put both DM and MS outside the vehicle with Tim still inside as well. Dungey just put out a hypothetical of a shot from outside the truck on the drivers side. If you knew you were going to shoot inside a vehicle you would probably want to be outside of it. I've though for a bit that the possibility of ricochet would unnerve anybody in a small, hard-surfaced space like a vehicle. This was yet another factor in my thinking that the killing was spontaneous/unplanned.
However...for the sake of argument, let's say that is what took place. Wouldn't that create an entirely different blood pattern than what was described here? MOO

As an aside, I am so incredibly impressed with the work that Law Enforcement and the Crown have put forth to see justice for Tim. We have Waterloo Regional, Hamilton Regional, Toronto and I believe Halton Regional polices forces working jointly to see this through. I sense that these men and women have gone above and beyond to ensure the right outcome. We have an anthropologist who got inside the Eliminator and made sure that she got everything she could. We have blood, video, gsr, fingerprint people who didn't just say it can't be done and went out and proved what needed to be proved. LE get a lot of bad press at times but these people really deserve our respect and they have my admiration.

I feel the testimony building as we are moving along and the pieces are all falling into place nicely.

DM and MS can have their day in court and say they're Not Guilty but the evidence has shown so far that they are.

Waiting patiently for that day to come. MOO

In his red hoodie and DM in his orange shirt. Hmmm. IMO the road was probably too far away from the camera and too dark to distinguish those details.

Well why wasn't the incinerator at the hanger where they needed it? Guns are used far more often to intimidate than they are to execute.

Whatever, we'll never know exactly what Tim may have done because his body was turned to dust. Smith and Millard will never tell the truth, so we are left to ponder what possibilities make sense.

And what did Millard tell people? "We're going to steal a truck". Would he do that if he was planning on killing someone?

There is audio this video, but it's near the HVAC system, so there's a lot of background noise. "Just as the vehicle arrives there are two quite loud booming sounds quite close together," Plaxton says.

To anyone wondering, this video was shot at Bobcat of Brantford Inc, not far from where Bosma's cellphone was found. Court still watching.

I have always wondered this. If it was always part of the plan, why didn't they bring this incinerator to the Hangar ahead of time? It does seem that it wasn't well planned out, thus could have been a last minute decision. IMO, MOO!
