We're continuing with more continuity evidence from from Zivolak.
by Adam Carter 1:34 PM

Zivolak is giving more evidence about how swabs of blood evidence are sealed, stored and transported to the Centre of Forensic Sciences.
by Adam Carter 1:39 PM

Officially the driest day of transcribing for me so far...

I find the whole media blackout (on legal arguments) frustrating. For those who have the ability to attend they get access to the info, while those of us on the other side of the country we do not. We must patiently wait for what scraps are allowed to be reported on.

I have been aware of this case since day one from seeing national news and was appalled at the brazen crime over a lousy truck. My thoughts certainly go out to the Bosma family, I cannot imagine what they have been through. I would, if I lived in the area be at the court but cannot. It just seems like a strange compromise that attendees can hear the objections but then cannot report. It almost should be behind close doors if they truly want blackout, especially this day in age. Nobody of course would want that. The only way we can we keep our courts feet to the fire is by allowing media to keep it in check. (me venting my frustration)

This is standard practice in Canada. Once the jury starts to deliberate the media will then post a story along the lines of "what the jury didn't hear" and that's when all the information will come out regarding the legal arguments that are happening. It is done this way so that the defendants have a fair trial, and the jury is not tainted.

I just heard Neil Pasricha ( author of The Happiness Equation) say the following:

"You are the average of the 5 people that you hang around with the most."

An interesting formula to apply to some of the key characters in this case....sounds similar to 'You are like the company you keep'.

May DM live on to eat those very words every moment of the rest of his life. Saying he was unable to get the family out of his mind was a clever manipulation so SS would believe he purchased a stolen truck, not stole it himself. I am so sad for the Bosma Family and friends who had to hear that in court yesterday. Like AJ did, I would need to vomit.

I can't fully fault SS for buying into that... Is only in hindsight that he sees how he was being manipulated when he suggests in court that DM was playing Dumb.... Something SS seems to be very good at himself. He did it back then --- and all through his testimony yesterday. Everything he said was self serving ...

.

Off topic note ..... seeing as it is a quiet day in court

I wonder if the recent MILLARD vs HER MAJESTY case is revenue Canada questioning things like SS being paid by Millardair to work on DM's PERSONAL cars etc

There is lots of flexibility between business and personal benefits when you own a corporation but if nearly everything SS did was stuff for DM and nothing to do with aviation there could be a chunk of personal taxes for DM to pay.

Baja race jeeps (for example) could never be a cost of sales for MAir unless it was as a major advertising sponsor , which clearly it was not.

CRA has its own investigators - the docket does say it's a criminal case. My hunch is that it is DM being compelled to testify in the CN case.

Here is that link for people that missed it: http://www.scc-csc.ca/case-dossier/info/dock-regi-eng.aspx?cas=36766

Can't help noticing he's paying yet another lawyer http://www.scc-csc.ca/case-dossier/info/counsel-procureurs-eng.aspx?cas=36766

Is this Lisa Whidden what you would call a hostile witness?

  • #94
Lisa Hepfner ‏@HefCHCHNews 18s18 seconds ago
Whidden did not speak to police or prosecutors. She is here under subpoena. Her phone was seized by police #TimBosma

yes indeed - very interesting, the texts about the power washer not being available in the hangar suggests this evidence is very valuable. Now I kinda understand why the SS cross examine is going to be delayed ... DM uncle's testifying that he NEVER EVER spoke to DM about cremation business - before SS saying it was the motivation for the purchase of the eliminator was brilliant thinking. Crown is addressing the credibility of this witness before he gets on the stand.

I am surprised that SS was not scheduled as witness for the defense...

That was early 2012. Sold house for him in spring 2012. She says they had an intimate relationship starting April or May 2012 until arrest.

Ooops! Should help along CN's testimony.

Zivolak is being excused, expected to return next week. Nothing about cross examination yet.

They had "hundreds of calls," primarily texts in that time, Crown says. She agrees. And emails, she adds. #Bosma
