The condo was not technically owned by Millard. Still owned by builder until "final closing." So Millard couldn't accept offers until then.

Dell texts her "a lot of accounting/banking **** has hit the proverbial fan this month." This was April 26, 2013.

Not a real estate agent or anything, but sounds like he had sunk funds into this new-construction condo (is this the 'distillery' thing?) and was chomping at the bit to unload it, either at a profit or just to get his initial investment back.

The first text starts with "I used to love the snooze button on my alarm now it just reminds me I have to pee." Then the texts go back to talking about the condo. Millard texts "Builders have me until May 9 as hard deadline to close or else." In court, Whidden says "It could eventually become a bank sale and go back to the builder."

All that talk of how he had almost $700,000 cash, no problem, to buy a condo. Um...no he didn't. Wonder where he eventually got it from? Because that deal did close. I guess we might find out?

Whidden says she doesn't know how much of Millard's own money he had to spend to close the condo vs the bank's money. "Another agent was tasked with selling it after Dell was arrested," she says.

Bingo! DM was trying to "sell paper". Goes something like this. He buys a property, in this case it was a condo in the pre-construction or construction phase. He puts down 10 or 20% of the purchase price- whatever the Builder required. Kind of looks like DM was going to have some problems coming up with the rest of the cash to close the deal and he got LW to list it for sale. She may have been getting into trouble because she was selling a unit for someone who didn't own it yet. Once he had a cash offer on the place, DM could take the offer to the bank and get bridge financing on it. Many pre-construction sales like this cannot be assigned to another Buyer- meaning the Builder would want DM to close it. Looks like the builder was pushing him and looks like he came up with the money in the nick of time! MOO

He had owned another Distillery District condo at one time and hung on to that for a while. I think he even tried to rent it out or did rent it out. I'm sure he hung onto it just long enough to make a good profit. Which was probably the original intent with this one. Looks like he needed/wanted to get out of that deal before it even closed this time. That would cut into his profit substantially I would think?
