They also dropped off a bike in Reno, V says. That he was going to pick up when he travelled again. And then an engine for Shane & the buggy

I guess that's why it took them the extra days?

DM also stopped in Reno when he was bringing back the Camaro from Texas. Does he have a property there? Where did they drop off the bike? Was this another EBike, a motorcycle, a BMX?? What kind of bike and where did they leave it? :waitasec:

Schlatman knew how to take windshield out of vehicle? Yes.

"It would be very easy for Mr. Schlatman to take a windshield out of a vehicle, would it not?" Dungey asks. "I would think so, yes," Villata says.
by Adam Carter 12:22 PM

Again...I find Susan Clairmont to be one of the more misleading Tweeters. I know there is a difference betwen AC's blog and actually Tweeting but this is a pretty misleading Tweet compared to what was actually asked and the response. MOO

Dungey specifies TO condo--that had nothing to do w Wayne? And Riverside? V says as he understood (assumed) that one was owned by the father

molly hayes ‏@mollyhayes 19s20 seconds ago
He says bc Mr Wayne Millard lived there (at Riverside).
Dungey says he's talking about from 2012 on. #Bosma

Susan Clairmont ‏@susanclairmont 23s23 seconds ago
Villada says decisions about apartments were Dell's. Same with the farm. But Wayne Millard also had input.

  • #164
"Mr. Millard's counsel went through great length the previous day about the benefits you received from Dellen Millard," Dungey says.
by Adam Carter 12:30 PM

He was living in an apartment of Millard's at a reduced rate, but renovating it as he was living there. He was also "taking care of the building."

V says it was also WM who instructed him about removing hay from farm bc it could cause a fire. #Bosma

molly hayes ‏@mollyhayes 55s56 seconds ago
The Riverside unit V was living in, he was renovating it at the same time. He was also the unofficial superintendent in the bldg. #Bosma

molly hayes ‏@mollyhayes 43s44 seconds ago
That's why he paid a reduced rent. #Bosma

Colin Butler ‏@ColinButlerCBC 18s19 seconds ago
Villada agrees the reason he paid reduced rent was because he was renovating the unit he was living in and he was superintendent of the bldg

For the red truck, he was paying Millard $450/mo. It was a verbal agreement, V says. (So roughly $5500/yr). #Bosma

Susan Clairmont ‏@susanclairmont 3s3 seconds ago
Paid Millard $450/month to lease red pickup.

  • #167
For the accountant types, is there any wonder now why the Oakville house was put in the ex's name? Capital gains? I doubt she saw any of the profits of that either.

Dungey now asking about the amount he was paying to lease a truck from Millard -- $450 a month. The white van was $250 a year.
by Adam Carter 12:33 PM

"You're using the red truck to do what Dellen Millard wants you to do, correct?" Dungey asks. "More than anything it was for my own transportation," Villata says. Dungey counters saying it was to do work for Millard, and Villata agrees.
by Adam Carter 12:35 PM

"You're actually paying Mr. Millard for his truck, when you're doing work for him, using his truck," Dungey says.
by Adam Carter 12:36 PM

by Adam Carter 12:37 PM

Villata says he's owed more than $20K in past wages and expenses from Millard.
by Adam Carter 12:38 PM

Villata says Millard would often be behind on payments, Villata says -- up to a month.
by Adam Carter 12:39 PM

Susan Clairmont ‏@susanclairmont 40s41 seconds ago
Sometimes had to wait a month to be paid.

molly hayes ‏@mollyhayes 33s34 seconds ago

molly hayes ‏@mollyhayes 2m2 minutes ago
He says that was money for supplies and to pay the workers. #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Dellen once paid Villada for supplies and wages in advance because he was going away.

Susan Clairmont ‏@susanclairmont 1m1 minute ago
How much money did Dellen have is a recurring theme in the trial.

molly hayes ‏@mollyhayes 31s31 seconds ago
Dungey: even though you're paying $450 DM could take the truck whenever he wanted?
V: exactly yes. Usually w/ a day or two's notice. #Bosma

  • #173
Dungey asking if Millard could come and take the truck whenever he wanted, even though Villata was paying him to lease it. Villata says "exactly."
by Adam Carter 12:42 PM

"And he would just take the truck for whatever period he wanted?" Dungey asks. "Yes sir," Villata says.
by Adam Carter 12:42 PM

Villata says Millard paid Smich (or other friends) working on a construction project, Millard would pay them directly.
by Adam Carter 12:44 PM

molly hayes ‏@mollyhayes 27s28 seconds ago
When DM had friends come work for V, he'd just pay them directly himself. V would just tell him the hours they worked. #Bosma

Colin Butler ‏@ColinButlerCBC 9s10 seconds ago
Whenever Millard had friends work under Villada, Millard would pay them himself

molly hayes ‏@mollyhayes 3s4 seconds ago
Mark and Marlena also did work at the hangar for Dellen, Dungey says. Painting. Cleaning washrooms. V says he believes so yes. #Bosma

Susan Clairmont ‏@susanclairmont 9s9 seconds ago
When Millard's friends worked for Villada, they were paid directly by Millard. Smich and girlfriend worked at hangar.

What a shady setup, indeed.
Pay the poor worker with a company cheque tagged with his SIN number and then what? Either they didn't make tax deductions or they did and then did not submit the funds to CRA. What about other deductions, what about other workers? The employer has to submit the company's share of EI, CPP at well.
Casual labour is one thing, guy gets paid a company cheque with no deductions for a very occasional work day, but certainly not a regular employee like JV. But send 10K to LW2 "for nothing done" Being self-employed as an agent, I wonder if she claimed this money on her tax return?
What a mess is right.
I really, really hope Millardair and all get a thorough audit, if they haven't already.

Many self employed people work every day for the same employer as independent contractors. In those circumstances it is their responsibility to take care of their own taxes. Apparently JV didn't take care of his taxes as an independent contractor and DM bailed him out with the taxman and then changed the work relationship to being an employee on the payroll so that JV didn't have to worry about having the same problem again. I'm guessing that when Millardair shut down after Wayne's death, that he was no longer able to keep that arrangement.

Also, real estate commissions and referral fees don't go directly from the seller to the agent in cash, they go from the seller to their lawyer to the agent's offices and then to the agent. I can't imagine someone working under the table in that situation, I assume since the money comes from their agency it would be hard to hide from their taxes. The agency probably got a cut of that money as well, which I imagine that they claimed in their taxes too.

Dungey suggests Mark and Marlena also lived at Riverside for a time. V says yes but there's confusion about which unit number. #Bosma

Would call Millard on his cell phone.

molly hayes ‏@mollyhayes 1m1 minute ago

molly hayes ‏@mollyhayes 51s52 seconds ago
Re: trailer, Dungey asks if it was used to transport other vehicles/machinery. V: yes. Dungey asks about a bobcat, V can't remember. #Bosma

Susan Clairmont ‏@susanclairmont 22s23 seconds ago
Now talking about 5th wheel trailer. Doesn't think Bobcat or wood chipper would fit inside.

molly hayes ‏@mollyhayes 4s4 seconds ago
Dungey asks about the excavator at the farm--did DM ever ask you to do any digging for him? V: no. #Bosma

  • #178
Villata says Smich and his girlfriend were living at Millard's home five or six months before May 2013. Villata also says Millard gave him a phone.

Smich says Smich and his girlfriend also lived at the Riverside property in unit #6.
by Adam Carter 12:46 PM

Villata says they lived in unit #5, but he doesn't know for how long.
by Adam Carter 12:47 PM

Dungey asks Villata how he usually contacts Millard, he says he usually contacts him by cell phone.
by Adam Carter 12:48 PM

Dungey asks if the black trailer was ever used to transport a Bobcat tractor -- Villata says he isn't sure, but he thought it would be too wide for that trailer.
by Adam Carter 12:50 PM

"Did Mr. Millard ever instruct you to use this piece of machinery to do any digging for him?" Dungey asks. "No, never," Villata responds. He says he did use it to make a hole to show his son how it worked, but never used it in regards to work for Millard.
by Adam Carter 12:51 PM

Dungey finished. Crown Tony Leitch now re-examining.

You don't pay capital gains on house sales in Canada unless you were renting it out (and even then there is a calculation based on amount of time as primary vs secondary residence). You DO however get a benefit if the purchaser is a first time home buyer. In that case you get certain purchase taxes\fees waived.
