Yet, IIRC, MH said they didn't hear of the new charges of FC until they (AM and MH) heard it on the car radio as they were driving on the way to make the drop to MS on Saturday? Is this not what MH said?

FWIW, I am not convinced by any of DM's missionaries' testimony. How can we pick the truth out from the lies or evasions?

MH lied to LE over 40 times. AM seems to be telling the truth.

wow so this testimony is a little different story than MH. Maybe MH was in shock mode and not really recalling things? He made it sound like they just randomly dumped stuff off in the stairwell....meanwhile it was all organized by Smich and AM...So there must be texts between Smich and AM?

MH said he just pulled over and stuck the stuff under a stairwell. AM is saying the place was prearranged.

And MH said the spot was not an agreed location between AM and MH. It was MH who apparently chose the drop spot.

Didn't MH say that him and AM heard on the news what DM had been arrested for and panicked, then immediately exited and ditched the items in a random stairwell. AM and MH definitely described the whole thing differently.

Edit: See everyone else is talking about the exact same thing!

Yes, they showed texts in court. MH is a known liar...it's no wonder the testimony is different. I think Mh also testified that they did meet in the park (not at his home)? Not sure on that but I would definitely go by AM's account over MH's.

He may have thought so but turns out he was mistaken. Seems like an honest mistake.

Perhaps an honest mistake, but one with implications. If DM gave the pack to AM, it appears to fit the MS was framed plan. If it was MS who directed it be delivered...a whole different implication.

That's the only reason I'm stressing this point...because of what either explanation implies.

If your familiar with AM'S FB, you'll see he ranges from MS'S size to bigger. His weight really fluctuated a lot!

Oh and I see he grew his hair long....no more duckbill in the front.

If Mark received a backpack full of various drugs? I would think it was probably worth alot of $$ - I guess not enough to afford a lawyer so he needed to sell the gun....

MS had no concept of how much a lawyer would cost , 100s of k's. Probably bankrupting his family.

I think there actually was a text about meeting in the park, but AM said that didn't happen.....

AM clearly told LE the same story (bc he referred to his police statement) right off the bat, while MH did not. It seems that some people really want to believe that MS was set up (why....I do not know), but to me the EVIDENCE is very clear that both of the DEFENDANTS (cuz I'm not allowed to use the words I want to) were there the night TB was murdered for a flipping truck.

Personally, I'm not overly concerned about the inconsistencies 'cos I find them somewhat irrelevant to the issue: that MS was deeply involved with DM all through the crime and immediately after, and that he was not being 'set up' by anyone. IMO.

In fairness, MH mentioned AM was texting someone while he was driving.

If he participated in a frame up, do you think he's going to admit it? Funny how these guys relied on texts exclusively, until it comes to that backpack and toolbox, then it's phone only. It's his word against Smich's, who you gonna believe?

BBM - and it looks much less like MS was "set-up"......he ASKED for the items.....

not sure why people are finding AM's demeanor on the stand so terrible......I think it's normal not to remember some things (ie: what someone's demeanor was, especially if it was just normal) and he seems to be IMO answering questions without a super selective memory. Has testified to extremely incriminating things about DM especially, but also MS. MOO of course.
I have read up until now and don't even recall once reading a "i don't remember" by him!

I think MS would sell the gun and consume the drugs ... HAAA ..... imagine MS's head during the tense days before his arrest .... likely paranoid about getting arrested while making a cloud of smoke trying to mellow out .

I would believe AM. Because he isn't on trial for murder. What would be AM's motivation to frame MS (besides to take the heat off DM.....which he clearly isn't trying to do)?

maybe this will be answered as I catch up but right now I'm confused. If AM says he didn't see DM any more that week after their little nonchalant chat about whether he stole a truck last night when did the backpack get handed over?

And again, there is NO WAY unless he is an ostrich that he would not have known about the owner of a truck exactly like the one they were looking at being missing. It was all over the news and would have been the talk of every workplace that he was at. I can't wait for MS lawyer to get hold of this guy.

edit: makes sense now... I thought MH testified that DM gave AM a backpack but appears AM packed the bag himself..

I respect your assessment of AM, but I disagree. He has lots to answer for yet, IMO, and he'll be subjected to cross-examination by the defense. That's when it was revealed by TD that MH had told 40 lies to LE.

Also, who is to say if MS called AM on the Friday night, and if so, what was said? We have only AM's account of the conversation so far. It could have been MS telling AM about the gun, or about drugs, or about both. IMO, AM will not admit to any knowledge of a gun. I think he is mentioning drugs because that may seem less involved or knowledgeable about what the plan was and what actually went down, IMO. I also don't buy that if MS alerted AM about DM's arrest, that MS would not have informed him about the details.

It could have been any other number of things AM and MS discussed on the phone, IMO. There will be another side of this story of AM's and I'm waiting to hear it before making up my mind. I hope we will hear it from TD's cross of AM, if not directly from MS himself.

Thieves don't make the most credible witnesses, IMO. And yes, at this point, I include both DM and MS in my view.

Nobody wants to believe MS was set up, but it's quite evident that is going to be his defence. Having two guys on the stand that can't get their stories straight doesn't help matters.
