My understanding is that MS's criminal record would not be admissible unless introduced by TD or if TD made reference to MS's character it could be referenced on a cross. My point is that TD is bringing it up......IMO to show that MS was a troubled young adult but also showing that his previous crimes have been non-violent.....MOO

I think the jury decides whether he's guilty, and for what. Then the judge takes some time, like a couple of weeks usually to decide on a sentence. The jury has no part in sentencing.
