MS is in for a marathon. The fact that Sachak is still circling the first question, MS will have his memory (time on stand) tested along with his endurance.

Smich is just as experienced at being a criminal as Sachak is at being a lawyer. I expect a long and frustrating few days, but already you are seeing obvious deception from Smich. By the time this is over the jury will have a very clear picture of him.

Not sure why DM is enjoying it. He's toast too.

I think DM is a vengeful guy. If MS doesn't give up the gun it makes himself look guilty but if he does he could be a target for the guy he gave it to. He's stuck and DM enjoys watching that.

I think DM's team doesn't have much to fall back on in terms of proving DM's role/innocence but I think by the time this is over it'll be enough where they both get first-degree. Although I thought that even before Smich took the stand.

Why doesn't he just say the size of the shovel??! I keep picturing the little ones a foot long, for hand gardening - to fit in his backpack. This is weird.

I think I posted that link a few days ago :) I have a family member who used to smoke pot daily from his teens until his late 20's and it's had a horrific affect on his memory. Now in his 50's it's something he struggles with all the time, and wishes he could go back & change :(

Ummmm, I'd bury the gun no matter if I was the one who actually pulled the trigger as well. At that point, he was probably just trying to cover BOTH of their tracks, not just his own. There's no way I'd want to be caught with a gun used in a murder even if I didn't pull the trigger.

Am I alone in that?

MS remembered everything DM did the night of the 6th and morning of the 7th. He even remembered giving MM a hug when he picked her up. And this was immediately after the horror night, an all nighter where he claimed to collapse once home.
MM remembered everything Daly told him.
MS remembered everything about the moment he received the toolbox from Arthur
MS remembered where the gun was in the garage, and that he wrapped it.

Too much of a memory loss the moment he decided to bury it for me to accept as truth.

I hope eventually it gets released to the public. <modsnip>

If someone is in court today, does the video indicate that MS has a black eye or facial abrasions? I am still trying to figure out if it happened during the time of his arrest or while incarcerated before his first court appearance of if MSM got that wrong.

I don't think he gave it back to ISHO. I honestly believe he buried it. The would he say about taping the gun up if he didn't bury it, that just makes him look more guilty. I feel that he buried two guns and that is why he can't reveal anything about it.

I suggested this scenario as well. MS is scum IMO but I can understand why he would respond that way and want rid of it. Especially with his sister telling him. He was likely paranoid and knew either way he had a massive role in Tim's murder. He knew either way he would be implicated. He benefits from not knowing but it doesn't 100% convince me that DM didn't pull the trigger either. Everybody is so sure of what they'd do if it were them but the brain reacts to crisis, stress and trauma differently. There is a psychology aspect there. I think MS knows way more than he's letting on but he's gonna go the CN route. But I could understand why he wanted rid of it thinking that would solve all his problems.

This. We aren't talking about smoking getting high and forgetting where you put your bag of Cheetos.

This is burying a gun used in the horrific murder of an innocent man, potentially putting MS in serious legal trouble and a life in jail. You don't forget where you buried that gun because you were high.

Blaming it on marijuana? Come on.

Sachak asks if it was a park or a playground, and Smich says no, it's a forest. Sachak asks if he saw any wildlife, and Smich says no.

Why would the grass be trimmed in a forest? He remembers that tiny detail but nothing else of the night?

"How deep into the ground did you dig?" Sachak asks. "Im not exactly sure," Smich says. Also says he doesn't know how long he dug.

As someone with a horrific memory, I feel for him. I have a very hard time remembering specifics in many situations, however other moments in my life are as clear as can be.
