My favorite comeback in this whole trial. Wish I was there to see the reaction.

How would lying about talking to MS instead of MM win her a defence from her ex boyfriend? DM didn't need her to say MS said he f'ed up, other witnesses said that of their own accord, and surely they weren't just saying that to curry DM's favour too. In fact, she said that he could have said 'We' f'ed up instead of 'I', she wasn't sure and probably annoyed DM by pointing out that he could have said either word, and that's not going to gain DM's defence, in my opinion. I think she said it because it was true. Is there any good reason why MS wouldn't want to talk to her that night? I would think he would be interested in any information she would have had to see how close to being arrested he himself was.

so did Arturo take the toolbox w/gun to his own house at some point? I'm wondering where this fits into the above timeline...because didn't MS, and I think BD, testify that Arturo's mom was very upset about it and yelled at MS in Russian?

Arturo's (Arthur's) mom yelled at MS in Russian apparently because Arturo told her what MS had asked him to do. Not sure if she was yelling because she found out he transported drugs on MS's behalf, or if she had been told it was a firearm?

After 2 days for those who have missed I can sum up Sachak's cross in 2 lines.

1.) Smich has no idea where the gun is
2.) Smich is not a very good rapper

Can't wait for day 3 to see what surprises are thrown at us today. Maybe Sachak can talk in a Russian accent when discussing Arthur.

Yes, imagine how the learned lawyer would feel having the uneducated rapper criminal ridicule him for his ridiculous cross examination questions. I'm sure Mr. S will show up all polished and rested today.

He hasn't once appeared polished since this trial began. I can't think of one worth while cross exam this guy has done. I am certain we will see a lot more of them the same.

Hopefully this thread stays open a bit longer .... I have something stuck in my mind what MS said DM said when they pulled over at Bobcat and DM approached him.

(According to Mark) the first thing DM said was ..... I AM TAKING THE TRUCK .... It came across as an announcement , as if he was giving new information to Mark ... and then instructed him to look for the Red Ram plates in the back of the Yukon and put them on the Black truck.

Yeah yeah I know .... he could have rehearsed and prepared to say that before he got on the stand. And again I am guilty of trying to read between the lines for .... WHAT MS DID NOT SAY ...... If he was inventing a story wouldn't he say they pulled over and he was expecting the test drive was over and TB would head home and DM would hop in the Yukon .... yada yada

People inventing fictional excuses usually try to add a bunch of details to make it sound credible but MS didnt even try.

I know not the reasoning for anything CN said. I'm not sure if DM through his correspondence with her, may have told her that MS said those words to someone else, and could have encouraged her to say the same, to perhaps add credibility. I can't imagine why MS, even if he did kill TB, would say to DM's girlfriend that he f'd up. In any case, I am simply saying that if given two opposing stories, one from CN and a different one from MS, I *personally* wouldn't give the one from CN any credit after having heard her testimony. That is only my opinion and is based on perceiving her time on the witness stand to have been chock full of bold-faced lies and lies of omission, etc.

To me, that is a weird thing for DM to have said... but yet somehow I can completely believe that he said it. According to MS's testimony, the two had scoped out ten 3500s during the year leading up to May 6th. Finally, here it was, the one that DM decided to actually 'take'.

That's 8 trucks scoped on top of Tumanenko truck & #Bosma truck. Sometimes truck moved or "it was just too difficult to get it," says Smich.

I doubt the Bosma's are laughing at MS's smarta$$ remarks. And I'm sure if DM had said it to TD, everyone would be outraged at the arrogance. But that's my opinion only.

He has been coached to keep details to a minimum. Harder to get tripped up on.

BD is the one, i believe, that MS told the effed up comment to. Also note: BD doesn't recall MS being shocked at the gun at all. TD was the one that kept saying that. imo. That being said yes it is surprising Artour (sic) is not up on the stand - was he the one there, when the box was opened?

That was said with a *little bit* of tongue-in-cheek, but at the same time, surely the man and his partner RP, must read the newspapers and see how his cross is being perceived as ridiculous by many.. and surely he may reconsider his demeanor for today. There is always hope, right?

Personally, I think BD's version is more reliable because it comes with details of the conversation. He described what they were doing, what they were watching, where they were watching it, and gave details about it like the specifics about the gun and bullets. What possible reason would he have to make up that story? He's not DM's friend, he has no reason to lie to implicate MS and nothing to gain from it. MS of course has everything to gain from lying about it, by contrast. So who is more believable?

Now that you mention it, I'm not sure if *anyone* was present when MS actually opened the toolbox for the first time and saw what was inside. Arthur was the one who fetched the toolbox and delivered to the exterior of MS's house, but not sure if he was around at the time MS opened it. And yes, BD is the one who stated that MS said, 'I f'd up', (possibly also to MM, can't remember right now off the top), but DM would have had this information by way of disclosure, and could have communicated it to CN or CN via Rabbit, etc.

There is so much negative emotion towards DM, that MS's silence during the trial has awarded him some benefit of the doubt. Sachak's style is not helping. DM has handcuffed his defence team's options.

The real cross of MS will begin when it's the crown's turn.

I suspect you're correct on both counts. It doesn't change the fact that the remarks are the (likely) result of Sachak's extremely annoying tactics. It's even been mentioned the judge has apparently grown weary of this.

It also doesn't change the fact that most see DM as an arrogant, self-entitled piece of garbage that used who he wanted, stole what he wanted, and carries on the very next day like nothing matters but his own pleasure. Not only did he come across this way 3 years ago, his current demeanor and conduct in the court still displays this kind of haughty attitude. By contrast, MS doesn't seem to be the same creep he was 3 years ago.

Simply put, most people find DM far more revolting than they do MS.

Agreed! He is MS's 'best friend', and he was not forthcoming to LE during his initial questioning. So why would he go from not 'ratting' on MS to framing him?
