It almost has a feel of him trying to remember what he said when he was asked this same questions by TD and NS. MOO

Ya I get that feeling too. After 8 or 9 days on the stand it would be hard to keep lies and situations you "don't recall" straight.

He has to be so careful. He must be getting tired. If he comes up with even one memory today that he "couldn't recall" in the last week, his whole testimony is wasted, IMO.

  • #42
I notice Fraser is putting heavy focus and constantly throwing out the word PLAN here... interesting
Is he hoping for a "trip up?"
Sounds like he did get a trip up. Didn't smich testify before Millard told him the keys were in the cup holder?

  • #43
"Coincidence or plan, Mr. Smich?" Fraser says.
by Adam Carter 11:08 AM

Fraser says according to Smich, the Bosma truck pulled a U turn and then goes west on Book Road. Smich then follows in the SUV.
by Adam Carter 11:10 AM

Fraser now pointing out the house of the neighbour who described seeing the truck and the SUV that night.

Smich says again it was "very usual" for Millard to leave his keys in the cup holder. #Bosma

Lisa Hepfner ‏@HefCHCHNews 31s31 seconds ago
Fraser: "You just got lucky, there (the keys) were? Coincidence or plan, Mr Smich?"

molly hayes ‏@mollyhayes 47s47 seconds ago
"Coincidence or plan, Mr. Smich?" Fraser asks. #Bosma

Susan Clairmont ‏@susanclairmont 39s39 seconds ago
Smich insists this was a normal thing. Crown: "Coincidence or planned, Mr. Smich?" Smich says it was normal.

molly hayes ‏@mollyhayes 48s48 seconds ago
Fraser says he's going to ask him now about his evidence that the #Bosma truck did a U-turn after dropping him off.

Alex Pierson ‏@AlexpiersonAMP 40s40 seconds ago
Fraser-"if u didn't have ANY conversation at all, how would u know DM keys were in the cup holder? Was it a coincidence or a plan?"

Lisa Hepfner ‏@HefCHCHNews 36s36 seconds ago
For the #Bosma truck to do a u-turn, the truck would have shone lights toward the east, Fraser says. Before heading west on Book Rd.

Susan Clairmont ‏@susanclairmont 23s23 seconds ago
Bosma truck doing U-turn, headlights would have faced east on Book Road, then winds up facing west.

molly hayes ‏@mollyhayes 56s56 seconds ago
Fraser suggests the lights in that case would've been facing directly east (on Book Rd), then heads west. #Bosma

Colin Butler ‏@ColinButlerCBC 34s35 seconds ago
Fraser asking about the u-turn now, saying the lights would have faced east. Fraser then says "remember mr Bullman?" #TimBosma

That witness said that field was owned by his father.
by Adam Carter 11:11 AM

He said trucks would go up there sometimes and dump garbage.
by Adam Carter 11:12 AM

That witness said on Feb 8 he was walking his dogs that night, and saw two vehicles pull out of his father's place. He thought seeing the second vehicle was odd.

BBM BINGO! It's not even so much him having to remember his storyline...it is remembering where he said he couldn't remember and when he actually had a response with detail. MOO

molly hayes ‏@mollyhayes 47s47 seconds ago
Fraser asks Smich if he remembers Mr Bulman's evidence (a resident at that intersection). Smich says yes. #Bosma

Colin Butler ‏@ColinButlerCBC 44s44 seconds ago
Mr Bullman didn't know the #Bosma family, Fraser says. #TimBosma

Susan Clairmont ‏@susanclairmont 29s29 seconds ago
Neighbour Bowman's house visible in aerial photo. He testified he didn't know the #Bosma family. He put his boys together at 8:30 p.m.

molly hayes ‏@mollyhayes 55s56 seconds ago
Bulman testified it was his nightly routine to walk his dog, as he did that night. #Bosma

molly hayes ‏@mollyhayes 40s41 seconds ago
The laneway (where Yukon was parked) was owned by Bulman's father. Testified that people dumped garbage there. #Bosma

Lisa Hepfner ‏@HefCHCHNews 37s38 seconds ago
Neighbour didn't know #TimBosma, but did notice the truck and Yukon leaving that field -- his dad's -- at about 9:15pm May 6 2013

Susan Clairmont ‏@susanclairmont 57s57 seconds ago
Then he walked the dogs through field owned by his father. Said he would see trucks in laneway dumping garbage in field. #Bosma

Lisa Hepfner ‏@HefCHCHNews 26s27 seconds ago
Fraser repeating neighbour Bulman's testimony, who was walking his dogs that night. "I seen 2 vehicles pull out of my father's place..."

molly hayes ‏@mollyhayes 26s27 seconds ago
Bulman said that the night of May 6 he was walking his dogs, and he saw two vehicles pull out of his father's place. #Bosma

Susan Clairmont ‏@susanclairmont 43s43 seconds ago
Bowman: "I seen 2 vehicles pull out of my father's place. One was a dark pickup truck, it was either dark blue or dark black."

molly hayes ‏@mollyhayes 26s26 seconds ago
Bulman said he didn't think much after the first vehicle (a pickup) left because he figured they were dumping garbage. #Bosma

Colin Butler ‏@ColinButlerCBC 13s13 seconds ago
On May 6 2013 he saw "two vehicles pull out of my fathers place" one a dark pickup, the other vehicle pulls out right behind "that's odd"

molly hayes ‏@mollyhayes 10s10 seconds ago
But when another vehicle followed it out, close behind, he thought that was odd. #Bosma

Lisa Hepfner ‏@HefCHCHNews 21s21 seconds ago
One was a dark pickup. I didn't think nothing because people often go there to dump garbage, Bulman said. But a 2nd truck pulled out

molly hayes ‏@mollyhayes 15s15 seconds ago
Bulman said they both pulled out and headed left down Book Rd. #Bosma

Susan Clairmont ‏@susanclairmont 15s15 seconds ago
"But then a second vehicle pulled out right behind it and I thought 'that's odd.'...

Colin Butler ‏@ColinButlerCBC 44s44 seconds ago
Bullman said the distance was close and the two vehicles "simultaneously" pulled out and left. #TimBosma

Susan Clairmont ‏@susanclairmont 38s38 seconds ago
It wasn't a pick-up, it wasn't a car, it was something in between...The first truck pulled out and the other was right behind it."

Lisa Hepfner ‏@HefCHCHNews 25s25 seconds ago
The 2nd truck was not a pickup and was following right behind the pickup. Bulman testified they pulled out of laneway at same time.

Colin Butler ‏@ColinButlerCBC 18s18 seconds ago
Bullman said he saw them pull out of his fathers property across the street. "They both pulled out at the same time," he told the court.

  • #48
That witness also said "Well usually, you just see one pickup. One vehicle pull out ... if they're curious or they're dumping garbage."
by Adam Carter 11:15 AM

"What's two vehicles doing back in there?" that witness said. "He doesn't have any vehicle on Book Road doing a Uturn ... he's got the Bosma truck coming out of the field, followed by the Yukon."
by Adam Carter 11:16 AM

Smich says the witness was wrong. "That's not what happened sir."
by Adam Carter 11:16 AM

  • #49

Smich says the witness was wrong. "That's not what happened sir."
by Adam Carter 11:16 AM

Another witness is wrong MS? This excuse is getting a little old.

Between all the witnesses that MS said were lying and now a witness that didn't see what he says he saw...MS is asking the jury to make quite the leap. MOO

Bulman said he thought it odd. "Usually you just see one pickup at a time, if they're curious or dumping garbage..."

molly hayes ‏@mollyhayes 15s16 seconds ago
Bulman said usually he'd only see one vehicle pulling out, but thought it was "odd" to see 2 pulling out together. #Bosma

Susan Clairmont ‏@susanclairmont 35s36 seconds ago
"They both pulled out at the same time...Usually you just see one pick-up, one vehicle pull out of the field at one time...

Lisa Hepfner ‏@HefCHCHNews 33s34 seconds ago
"I thought it was kind of odd to see two vehicles pulling out at the same time," Bulman testified months ago.

Susan Clairmont ‏@susanclairmont 57s58 seconds ago
"...When I seen the second vehicle I thought it was kind of odd to see two vehicles at once pulling out of that field."

molly hayes ‏@mollyhayes 51s52 seconds ago
When asked why it was odd, Bulman had said "what's two vehicles doing back in there? I don't know." #Bosma

Lisa Hepfner ‏@HefCHCHNews 36s37 seconds ago
Bulman wondered what two vehicles would have been doing back there. Fraser asks Smich about discrepancy with his testimony.

Susan Clairmont ‏@susanclairmont 50s51 seconds ago
Bowman has 2 vehicles coming out of the field with no U-turn, says Crown. Smich agrees.

molly hayes ‏@mollyhayes 44s44 seconds ago
Fraser says Bulman puts two vehicles in there. No U-turn. "Coming back from the field and out the driveway." #Bosma

Susan Clairmont ‏@susanclairmont 36s36 seconds ago
Crown: "He got it wrong? Dead wrong." Smich: "Yes sir. That's not what happened."

molly hayes ‏@mollyhayes 36s36 seconds ago
When Bulman got a flyer about missing man Tim #Bosma, he knew what he'd seen was odd so he called police.

Lisa Hepfner ‏@HefCHCHNews 56s57 seconds ago
Bulman did not see a u-turn, or a pickup waiting for a Yukon. Smich says Bulman was wrong. The next day Bulman got a #TimBosma flyer at door

molly hayes ‏@mollyhayes 43s44 seconds ago
Smich insists the one vehicle did a U-turn and he followed out. #Bosma

Colin Butler ‏@ColinButlerCBC 37s37 seconds ago
Fraser says Bullman called police next day when #TimBosma flyer landed at his door. That's how odd what he saw was, Fraser suggests.

Susan Clairmont ‏@susanclairmont 35s35 seconds ago
Smich: "No sir. The one vehicle did a U-turn and I followed out." Fraser suggesting both vehicles parked in field.

Lisa Hepfner ‏@HefCHCHNews 42s43 seconds ago
As soon as Bulman saw the flyer he called police, because what he saw, two trucks leaving the field, was so unusual to him, Fraser recalls.

molly hayes ‏@mollyhayes 29s29 seconds ago
Fraser asks if Mr Bulman got it wrong, if that's what he's saying. #Bosma

Lisa Hepfner ‏@HefCHCHNews 12s12 seconds ago
"Mr Bulman, who carefully and methodically explained what he saw, he got it wrong Mr Smich? He got it wrong?"

Lisa Hepfner ‏@HefCHCHNews now
Fraser says Millard and Smich killed #TimBosma in the field. That's why they turned off their cell phones moments later as they drove away

"He got it wrong Mr. Smich? Is that the story?" Fraser says. "He saw two vehicles coming out of that field .. You know why they were in that field? Because that's where you and Mr. Millard shot and killed Tim Bosma."
by Adam Carter 11:18 AM

"That's not what happened sir" Smich says.
by Adam Carter 11:18 AM

"You killed Mr. Bosma and you don't want to be followed," Fraser says about Smich and shutting down his phone.

WOW- just WOW. Crown is doing an amazing job. My heart breaks hearing this.

Fraser says they left the driveway around 9:10 p.m., and were at Bobcat of Brantford by 9:48 p.m.
by Adam Carter 11:21 AM

"Mr Bosma was killed in that field, and you two had to do some repositioning of the body at Bobcat of Brantford," Fraser says. "You followed him sir, that was a choice you made, because it was part of the plan." Smich again says no.
by Adam Carter 11:23 AM

Fraser now saying there was no activity on Bosma's phone between 9:05 p.m. and 10:02 p.m.

Smich says he did see two vehicles as he said.
Fraser says "no he said the two vehicles were in that field..."

"You know why they were in that field? Because that's where you and Mr. Millard shot and killed Tim Bosma." #TimBosma #Bosma

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Fraser suggests #TimBosma was shot and killed in that field by both men. Smich says Bullman got it wrong.

Susan Clairmont ‏@susanclairmont 59s59 seconds ago
"He said those vehicles were in that field and you know why they were in that field?...

Susan Clairmont ‏@susanclairmont 48s48 seconds ago
"...Because that's where you and Mr. Millard shot Mr. Bosma...That's what happened Mr. Smich. There was no U-turn on Book Road."

molly hayes ‏@mollyhayes 39s39 seconds ago
"And you know why they were in that field? Because that's where you and Mr. Millard shot Mr. #Bosma."

Lisa Hepfner ‏@HefCHCHNews 2m2 minutes ago
Smich is sputtering. "Like I told you, the vehicle did a u-turn and I followed it out."

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
"I'm not sure where he seen it" Smich says. "There was a u-turn and I followed." #TimBosma

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser says again the phone thing (his phone powering down at roughly same time as Lucas Bate phone) was not a coincidence. Smich disagrees.

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
It's not a coincidence they both turned off their phones, Fraser says. "You killed Mr. Bosma and you didn't want to be followed."

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Fraser: "This idea of a coincidence with the two phones...it's not a coincidence...

Susan Clairmont ‏@susanclairmont 1m1 minute ago
"...You powered down because you know you're being tracked and you killed Mr. Bosma and you don't want to be followed."

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
Fraser is going over timing. 9:10 they leave drive. 9:48 they're at Bobcat of Brantford. Smich following the whole time.

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser giving a timeline. Roughly 9:10 they leave the #Bosma house, after about 5 minutes Smich agrees.

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Crown says 38 minutes from Bosma house to Bobcat in Brantford. And you don't see anything in that vehicle as you follow?

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
And he doesn't see anything on? Just two people on a 38-minute test drive? Smich says it was a country road, not well lit.

molly hayes ‏@mollyhayes 1m1 minute ago
They stop at Bobcat of Brantford 38 minutes later. #Bosma

Lisa Hepfner ‏@HefCHCHNews 47s47 seconds ago
There and back, over an hour, Fraser says. "Nobody goes on a two-hour test drive to another city."

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
"That's over an hour test drive," Fraser says. "No one goes for that long a test drive." #Bosma

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Crown: Nobody goes for a test drive for that long to another city. "There never was a test drive. Mr. Bosma was killed in that field."

Susan Clairmont ‏@susanclairmont 1m1 minute ago
Smich says no.

molly hayes ‏@mollyhayes 1m1 minute ago
Fraser: "Nobody goes on a test drive for more than an hour, to another city. It's not what people do, & it's not what happened this night."

Lisa Hepfner ‏@HefCHCHNews 1m1 minute ago
#Bosma was killed right away, Fraser says. "At Bobcat of Brantford you had to reposition the body," he says

Susan Clairmont ‏@susanclairmont 1m1 minute ago
"You followed him because that was a choice you made," says Fraser. Smich says "I was terrified."

Colin Butler ‏@ColinButlerCBC 1m1 minute ago
Smich denies Frasers version of events. #Bosma

Alex Pierson ‏@AlexpiersonAMP 2m2 minutes ago
"U killed him in that field and drove away. That's what happened. U powered down your phones cause u didn't want to be followed."@AM900CHML

molly hayes ‏@mollyhayes 2m2 minutes ago
Fraser suggests there was no test drive. That they killed Mr #Bosma and stopped in Brantford to do some "repositioning of the body."

molly hayes ‏@mollyhayes 1m1 minute ago
"You followed him sir, that was a choice you made, because it was part of the plan," Fraser says. Smich disagrees. #Bosma

  • #58
"There's nothing on his phone until it's powered down ... no attempts by Mr. Bosma to call his wife, 911, nothing," Fraser says.
by Adam Carter 11:24 AM

"At that point, you had a dead and bleeding Tim Bosma inside your truck," Fraser says.
by Adam Carter 11:25 AM

Fraser says if Smich really was shocked, he wouldn't have followed Millard to the farm like he testified. "I was terrified and didn't know what to do," Smich says.

Smich is sputtering. "Like I told you, the vehicle did a u-turn and I followed it out."

IMO, MS is being rattled for the first time on the stand.

I was kinda leaning towards believing MS's story, but listening to this stuff from Fraser now, has put me back on track. Both of them are guilty. BOTH.
